“If the protection comes out, the entire decree falls,” says Rizzo

After getting the fair enabled and dismantling the collective process of the DNU, lawyer Jorge Rizzo, argued that if the Federal Administrative Litigation jurisdiction gives rise to the protection they presented once morest the Decree of Necessity and Urgency (DNU) of deregulation of the economy of the Government, all the modifications established there are “fallen” and he estimated that “next week” Justice might issue a precautionary ruling.

“If the protection we present comes out, unlike all the others, the entire DNU falls. Next week we would be in a position to issue a ruling on the precautionary measure,” Rizzo said in radio statements.

In that sense, he celebrated that the Administrative Litigation jurisdiction in charge of Judge Enrique Lavié Pico, who “generally does what governments ask of him” has enabled the fair and has ruled out the collective process between various protections that “was going to block all”.

“This is our job. We are pressing very hard with protections such as that of the CGT, that of the CTA, that of the Observatory of the Right to the City and ours are the main ones,” he noted.

This Thursday, the magistrate enabled the separate processing of each judicial presentation made once morest the Government’s DNU, while the National Chamber of Labor Appeals issued a new precautionary measure that suspends the application of the labor chapter of the norm.

Rizzo’s presentation was made on December 26, considering that the DNU breaks with the republican principles of the division of powers and is “unconstitutional.”

Meanwhile, Rizzo maintained that the Treasury Attorney, Rodolfo Barra, “had a great influence” in the Administrative Litigation jurisdiction during the government of Carlos Menem so he was “calm”, but that “evidently he did not realize that thirty years”.
