A case that traveled through the judicial pyramid


The defense challenged the sentence in all instances. He appealed to the Superior Court of Justice (STJ) of Río Negro, which rejected an extraordinary federal appeal in November 2021 with which he attempted to take the case to the Supreme Court. However, Ocares remained free.

The defense tried the last resort with a complaint before the highest court of justice in the country, which dismissed it on December 14. For this reason, the man’s arrest was ordered and then he was transferred on December 19 to the Bariloche prison.

For The judges, the prosecutor’s office and the plaintiff proved in the trial the abuses committed by the foreman of the municipality of Pilcaniyeu.

Both the prosecution and the complaint proved beyond all reasonable doubt that in the period of time established in the attribution, Sandro Walter Ocares sexually abused the victim on two occasions.

The victim reported Ocares in March 2019 at the police station in that town and due to the seriousness of the events, the case was immediately referred to a Bariloche prosecutor’s office. The investigation took several months until the case went to trial.

The prosecution and the complaint accused him of having abused the victim at the municipality’s museum at the end of February 2019. The woman was hired and carried out cleaning tasks.

Ocares took advantage of the fact that she was alone, attacked her and committed sexual abuse with carnal access to the detriment of the victim, the judges warned. The second simple sexual abuse (touching) happened on March 8, 2019 on FM Patagonia radio. The woman was alone and Ocares burst into the scene. The frightened victim took refuge in the bathroom, but the man forcibly opened the door, entered and groped her.

The judges valued the victim’s testimony that was corroborated by other evidence, such as the statements of the witnesses who heard the woman’s drama, when he dared to tell what he had suffered. They also took into account the statements of the specialists who evaluated the victim and warned, for example, of post-traumatic stress.
