Charles (not his real name), 20 years old, was opposing a judgment which sentenced him to 8 months in prison. He is being prosecuted for stealing a car on November 5, 2022.
The Mouscronnois explains that he had gone out clubbing and that he was drunk. “When I wanted to go home, I saw that my girlfriend had left without warning. There was a car in the parking lot and the driver told me he might drop me off.”
But what happened next? Charles points out that at one point he and the driver stopped to urinate along the side of the road. “Then I vaguely remember that I found myself driving the vehicle alone. There was no one next to me…”
The Prosecutor highlighted the driver’s friendly gesture towards Charles, to say the least, but also Charles’ much less friendly behavior. He requested the same sentence but with a simple reprieve.
The defense recalled that his client was not at all thinking clearly at the time of the events. “He admits to having taken the vehicle while the driver was urinating. My client was very lucky because for the same price, he might have hit someone. He realized what he had done “He consumes alcohol occasionally. We are requesting a sentence of independent probation with the measure of no longer consuming alcohol to excess or a simple or probationary suspension.”
