Understanding Chemsex: The Tragic Case of Death After a Night of Drug-Fueled Sex

Four years in prison with suspended probation were required once morest Pierre for inciting or facilitating the use of narcotics with the circumstance that this caused death.

The judgment was delivered this Thursday at 9 a.m. Pierre receives a twelve-month suspended probation sentence. “It’s a special case. But what is important is that the context was taken into consideration for the judgment,” said Denis Bosquet, Pierre’s counsel.

If the lawyer insists on the importance of context in this case, it is because at the heart of Jérémie’s death, there is a story of Chemsex.

Death following a night of drug sex

Drugs to boost sexual performance

Chemsex is sexual intercourse under the influence of drugs to boost desire and performance. The phenomenon is popular with part of the gay homosexual community.

On August 18, 2019, Pierre came into contact with Jérémie via a dating application. “We exchanged our sexual desires. We talked regarding the use of narcotics. And the meeting happened. I arrived at his house, Pierre explained in court. We were two adults and we decided to do things together.”

Pierre says he came with his GHB and his cocaine. Jérémie had little GHB in his home and, it seems, no cocaine.

To avoid any problems, Chemsex enthusiasts note the times they take their drinks and each person determines their quantity. Everything seemed perfectly organized. Until the moment when Pierre says he fell into a “black hole”, just following a take at 10:30 a.m.

Three hours later, Pierre wakes up. And discovers Jérémie’s lifeless body next to him.

“Balanced” judgment

During the hearing on November 23, Pierre repeated that all this did not “correspond to his values”. “I felt that I was in my right mind and that I had nothing to hide. I didn’t feel like I did anything wrong,” he said.

His lawyer had argued that, in this case, there had been mutual consent between adults, both for sexual relations and for the consumption of drugs.

He had also pleaded for acquittal as the main reason, arguing that Jérémie’s heart would have been weakened by regular use of cocaine. This was contested by the civil party and the prosecution, referring to the conclusions of the autopsy which attributed the death to a combination of GHB and cocaine.

Me Xavier Carrette, lawyer for the civil parties, contested the “black hole” thesis. And pointed out that around 10 a.m., a neighbor heard Jérémie shouting ‘But what are you doing to me?’ before hearing him spit and cough vigorously. “Pierre supplies (the drugs), manages, perhaps he even insists,” Me Carrette deciphered.

For Pierre’s lawyer, the judgment rendered is “balanced”. “My client has already started work to move forward, even though all of this will affect him forever.”
