Apple settles $25 million in Family Sharing lawsuit

A Apple agreed to settle a class action lawsuit over the Family Sharing and will pay a total of US$25 million to litigants and lawyers. Although subscriptions and purchases are shared with other family members, application developers can disable this option. The fact that this possibility was not clear to users, with a distortion of conditions, was what motivated the action.

The process, titled “Walter Peters v. Apple Inc.”, was filed in 2019 in the Superior Court of California. Apple denied having made any error, as well as that the Family Sharing conditions had been distorted. The company, however, decided to agree to the agreement, as continuing with the process would be onerous and even more expensive.

They may be included in the agreement and receive between US$10 e US$50 users who have been in Family Sharing groups with at least one other person in between June 21, 2015 e January 30, 2019residing in the United States at the time and who started a subscription to a third-party app, through the App Store, during this period.

Three options were given to people potentially included in the action. The first is to agree to continue the action and receive the amount, but give up the right to sue Apple in a separate action; the second, in turn, is to leave the action and be able to sue Apple; while the third is to file an objection to the agreement. Emails are being sent to eligible customers; the deadline for choosing is the day March 1, 2024.

In day 2/4, a hearing will take place, at which possible objections to the agreement may be expressed and final approval of the agreement will be requested from the court. In the approval decision, the amount to be received by each person will be defined; until US$10 million should be allocated to fees and fees.
