The two ex-partners who denounced Diego Oscar Bobattoformer president of the Club Instituto Atlético Central Córdoba for gender violence, advanced this Monday in the signing of an agreement to reach a suspension of trial, known as “probation” by which the criminal action is extinguished for a period of three years under the fulfillment of certain conditions.
The agreement was drafted this Monday, when the first hearing of the oral trial was scheduled for the accusations of threats, coercion and prevention of contact made by CC and MGP, two former partners of Bobatto during the years 2013, 2017 and 2020.
The prosecutor of the 8th Crime Chamber of the city of Córdoba, Hugo Almirón asked the parties to reach an agreement and suggested the suspension of the trial, known as “probation”, a measure that is usually applied for minor crimes although it is not common in cases of gender violence.
Both CC’s lawyer, Juan Fernández Alé, and MGP’s lawyer, Julio Deheza, maintained that it was not an easy decision for the parties, but that it was made prioritizing the best interests of the children, since Bobatto has a 17-year-old son with him. to CC and a 9-year-old daughter with MGP. With the last one, it still maintains a communication regime.
The agreement, which will be presented to the 8th Chamber and whose member, Marcelo Jaime, must decide whether to approve or reject it, provides for specific conditions such as the payment of a sum of money to the complainants as compensation for the damage caused in these years, in addition to the dismissal by Bobatto of all the civil lawsuits initiated by him once morest the two ex-partners, which are between 15 and 20 once morest each one.
Furthermore, as provided for in any suspension of trial, Bobatto must have impeccable conduct during those three years, otherwise the oral trial will be held.
After the agreement is presented, the 8th Chamber can accept it and in that case determine the conditions that Bobatto must meet, whether community work, psychological treatment, among others. On the contrary, if the Chamber considers that probation is not appropriate for this type of case, it will proceed in an oral trial as planned or in an abbreviated trial if there is agreement between the parties.
The sentences for the crimes of which Bobatto is accused provide sentences of around three years of effective compliance. If “probation” is given, Bobatto would be exempt from a sentence and therefore, from prison.
Complaints
The first complaint is from 2013 when CC made a threat at the door of a private school in the northwest of the city of Córdoba. There, while they were taking their common child to school, the former head of the Institute allegedly threatened CC by running his finger across her neck, a sign of a fatal attack.
The second complaint is from 2017 by MGP, Bobatto’s partner at the time, who filed two complaints regarding threats. One of them happened in intermission quarter of a hearing in the Family Courts, when the leader, who is also a lawyer, would have made a gesture to MGP similar to that of the previous episode with CC.
Then in 2020 MGP reported him for impeding contact because Bobatto had deprived MGP of seeing their daughter for weeks, during a time of health restrictions due to the coronavirus pandemic.
For all this, Bobatto faces prosecution for “threats” (two facts), “qualified threats” and “impeding contact.”
