The head of Federal Court 2 of the City of Córdoba, Alejandro Sánchez Freytes, granted the precautionary measure requested by the Government of Córdoba in the amparo action initiated once morest the Central Bank of the Argentine Republic (BCRA). The claim arose from a resolution in recent days that prevented access to the Single Exchange Market to acquire dollars to meet debt maturities in foreign currency.

Specifically, Juan Schiaretti’s management claimed for the purchase of 144 million dollars, which correspond to the payment of a capital and interest maturity on an external credit. The Central postponed that possibility of purchase until Monday the 11th, which in the Civic Center of Córdoba was interpreted as a failure to comply with another current precautionary measure.

“Declare the inapplicability of Communication “A” 7904, dated 11/30 of the current year, and order the defendant that once notified of this resolution allow the plaintiff with the necessary immediacy to access the exchange market to acquire the currencies to cancel the obligations in concept of capital and interest in foreign currency (dollars), whose maturity operates on December 10 of the current year, all in accordance with the fundamentals developed in the recital of this pronouncement,” the resolution maintains.

In this way, Córdoba will be able to access the purchase of foreign currencies. This is the third favorable resolution that the province has received from Justice, since last June and July precautionary measures were also obtained that allowed it to access dollars to pay international credit maturities.

Schiaretti’s team interpreted this refusal to authorize the purchase of dollars before the debt matures as a deliberate obstacle by the head of the Central, Miguel Pesce, since it is not ruled out that next Monday the value of the official dollar will be substantially higher.

“To give rise to the lawsuit filed by the Province of Córdoba, once morest the BCRA and declare the inapplicability of Communication “A” 7782, without prejudice to the full validity of the payments made due to the execution of the precautionary measures provided, and confirmed by the Court, and those payments that had been made within the framework of the partial agreement, as the latter were the result of a free agreement of wills,” added the official statement from the justice system.
