Jimmy Sotomayor, lawyer for the relatives of the firefighters who died at the Jorge Chávez airport, asked this Monday the Public Ministry to initiate a preparatory investigation for an oral trial in which he will request to include the Peruvian Corporation of Airports and Commercial Aviation (Corpac) as civil liability, following the dissemination of a video that reveals negligence and cover-up in the accident.

“We ask the Prosecutor’s Office to accelerate this investigation. We are still in preliminary investigation, [lo cual] It is unacceptable. With these elements, the case should already be prosecuted in a preparatory investigation, and we are waiting for this to request the official incorporation of Corpac as a responsible civil third party,” said the lawyer in dialogue with Exitosa.

In the graphic record, released by Sudaca, you can see how the supervisors question the controllers in the tower, who admit that they were informed by the firefighters of their intention to carry out an exercise on the landing strip, even though they were not warned that There was a plane regarding to take off.

Subsequently, another of the supervisors asks those present to prepare their reports, but without specifying that the firefighters mentioned the intention to enter the runway. For the defense, this video “is completely explicit and completely destroys the report” of an investigation group, which stated that “the controllers would not have contributed to the cause of the accident.”

“It shows us coordination, yes, but not for the exercise, but rather to hide evidence or to align on a single version.[…] In the opinion of the defense, this should be investigated as a possible crime of real and personal concealment. It will be the task of the Prosecutor’s Office to define who had this video and why it was not handed over,” he mentioned before specifying that the case no longer constitutes culpable homicide, but rather with possible intent.

Sotomayor said that Corpac, in charge of the Lima airport tower, delivered the record to the Prosecutor’s Office, but without audio or time. “But they don’t say that in their statement,” he said, referring to a statement released hours before the general manager, Roger Bernedo, blamed the victims for causing the tragedy.

The manager told Punto Final that, when exercises of this nature are carried out, Lima Airport Partners (LAP) carries out the coordination at a work table. “That never happened. There were coordination problems and we accept that, but the main cause of the accident is that the protocol of requesting authorization to enter the track was not followed. (…) The authorization given is for the start of the exercise, not track authorization,” he added.

However, Emilio de la Torre, president of Corpac, reconsidered this position following appearing before Congress. “I can’t conclude anything [sobre la actuación de los bomberos]. There are definitely shared responsibilities. We are in an investigation meeting. While [los trabajadores involucrados] They are not sentenced, the labor law protects them,” he said.

Subsequently, in a press conference, the Minister of Transportation, Raúl Pérez Reyes, announced that he ordered a reorganization of the entire operational part of air control “in light of the notorious and obvious problems that have been seen in the videos.”

A report presented on September 30 stated that there was no adequate relief of the air traffic controllers and a protocol for managing their fatigue when the fire truck collided with the aircraft on takeoff. The document contains the conclusions of the investigations of the Aviation Accident Investigation Commission (CIAA) following the accident that occurred at the Lima airport on November 18, 2022.

The aeronautical firefighters were doing a drill and their truck was hit by a wing of a passenger aircraft that was traveling along the runway to take off, which caused one of the turbines to catch fire and the instant death of two of the rescuers. A third firefighter, who had been seriously injured, died seven months later in a health center.
