Last March, a five-month-old baby was presented to the emergency room following falling down the stairs with Tania*, the nanny who had him in her arms. But, in addition to a fracture of the tibia and fibula, medical examinations revealed a fracture of a rib, prior to the fall. A scratch mark was also found on one of the child’s cheeks. Pressed with questions, the 28-year-old Brazilian, who had the baby in her care, ended up admitting that a week earlier, the baby had fallen out of bed. She also said the injury to her cheek was inflicted accidentally by her dog.
The parents filed a complaint in April. In addition to bodily injury through negligence, Tania is also being prosecuted for her illegal stay in Switzerland since 2018 as well as having carried out a lucrative activity without authorization.
Justice also accuses Tania of having hidden the baby’s first fall from parents as well as health professionals. The young woman was sentenced to 180 days’ fine of 30 francs with a two-year suspended sentence, and a fine of 800 francs convertible into eight days’ imprisonment in the event of culpable non-payment. The approximately 4,600 francs in procedural costs were charged to the nanny.
