After a second municipal inspection on the property of the kilometer 12 mall in Bahía Serena, the Secretary of Environment and Urban Development of Bariloche, Claudio Otano, reported that the inspectors confirmed the progress of a work and therefore, A criminal complaint will be filed with the Prosecutor’s Office.
«We are talking regarding an attempt to build a mall. It does not have a permit to build – nor might it have one – because it is not an area that allows construction.«Otano summarized.
The Municipal Organic Charter, he recalled, stipulates that “the Municipality protects and regulates the rational use of wetlands within the ejido, favoring their maintenance.” But in addition, a study carried out by the Bariloche Regional University Center (Crub) determined that the kilometer 12 mallín is «an environment of great fragility and with periods of frequent flooding«.
The first inspection on that property was carried out weeks ago and the inspectors found a work in progress “without plans or license to build “in an affected area of 20 square meters.” On that occasion, work was paralyzed.
The Arbol de Pie organization made another claim to the Municipality and a second inspection was reiterated this Monday morning. «There is a construction of concrete piles on the ground with the intention of making an elevated property above the surface of the mall to avoid future flooding. But we are talking regarding an area protected by the Organic Charter. Even though the property is private, it has a legal limitation: it cannot be built.«Otano specified.
The property is located at 300 La Avutarda Street, at kilometer 11.6 of Bustillo Avenue.
Given the progress of the work, Otano insisted that he will resort “to ordinary justice, just as we did in March for a work, without permission, at kilometer 5 and with the works on the northern slope of Cerro Otto, near Piedras White. It is the only path we have left when the measure taken by the Municipality is not obeyed. Otherwise, non-compliance with municipal regulations is naturalized.
He warned that the Municipality lacks “sanctioning power.” What we do is inspect and draw up a report in case we determine regulatory non-compliance. That record goes to the Misdemeanors Court 1 which determines the sanction. If there is a repetition of the sanction, they can request demolition or impose fines. If the work is not stopped, we have the legal path left«.
He also said that “there is no secretariat in the history of the Municipality that has led three criminal complaints for non-compliance. It is always in the hands of the Misdemeanor Court to determine the steps to follow. Here we go one step further with criminal actions. “To generate a record and let people know that we do not sit idly by.”
