DMA: Apple will appeal decision that regulates the App Store and iMessage

Despite saying that it would comply with the decision of the European Commission that framed the App Store and the iMessage as gatekeepersaccording to the Digital Markets Law (Digital Markets Actor DMA)a Apple will still not give up on reversing the bloc’s understanding. The company is preparing to appeal the normative act that designated the two services with the aforementioned classification.

According to the Bloombergthe company will take the case to the General Court of the European Union, in order to try to question and reduce the scope in which the App Store is considered a gatekeeperseeking to avoid having to allow the installation of applications by other methods — the so-called sideloading.

Apple is also expected to seek to reverse iMessage’s designation under the law’s classification, repeating its previous claim that the messaging service does not have enough users in the EU to be considered a gatekeeper. Apple will have until the day November 16 to file the appeal.

According to Bloombergthe company is still in a phase of planning the arguments to be used and what exactly will be requested, which must be decided by the end of the deadline for appeal, on the 16th. Even filing the appeal, however, the Commission’s decision European Union needs to be complied with, until the court issues a contrary ruling, accepting Apple’s allegations.

The idea behind the Digital Markets Law is to limit the dominance of Big Techslike Apple, using the designation of gatekeeper, which is an essential service with a large number of users and market value. Apple already faces other scrutiny from the bloc, such as those related to taxes in Ireland and Apple Music.

The EU’s main objective with these regulations is to make large services interoperable with smaller ones, favoring competition and curbing unfair/monopolistic practices. It also became illegal to favor one’s own services over rivals, as well as combining data from different platforms for the same user.

In the case of the App Store, what displeases Apple most is the possibility that apps can be downloaded outside the company’s store, in addition to transactions being made outside the system created by the company — and avoiding paying the commission charged by it. It has already been considered, however, that the company would be preparing to allow the sideloading.
