Apple’s Violation of Employment Standards and Settlement with DOJ: What You Need to Know

Apple said it ‘unintentionally’ failed to meet employment standards

A hot potato: Apple has agreed to pay $25 million to settle claims by the U.S. Justice Department that the Cupertino giant illegally favored hiring immigrant workers over U.S. citizens and green card holders for certain jobs.

At issue is the Permanent Labor Certification Program, or PERM program, which requires companies to prioritize and hire permanent U.S. residents. Organizations must prove that there are not enough U.S. workers available and be certified by the Department of Labor and U.S. Citizenship and Immigration Services if they want to prioritize hiring immigrants.

The DOJ said in a statement (via Archyde.com) that Apple did not advertise PERM-eligible job openings on its website, as it usually does for other positions. Additionally, the company asked all applicants to submit their applications on paper, although it normally allows electronic submissions.

“These less efficient recruitment procedures almost always resulted in few or no applications for PERM positions from candidates whose work authorization did not expire,” the department said.

The Justice Department did not reveal exactly which positions were affected by Apple’s hiring procedures or how Apple might have benefited from them. It has been noted that using foreign workers can often be less expensive than hiring workers in the United States, and that immigrants who rely on employers to obtain a green card are generally less likely to leave for another job.

Apple admitted to “unintentionally” failing to comply with the DOJ standard. “We have implemented a robust remediation plan to comply with the requirements of various government agencies as we continue to hire American workers and expand in the United States,” the company said.

In addition to handing over the $25 million, Apple agreed to follow the rules for recruiting for PERM jobs. It will also be asked to recruit more and train its workers on anti-discrimination laws.

Apple is proud to be an organization that values the diversity of its workforce. The company has published an inclusion and diversity report every year since 2014, the most recent of which shows that representation of the underrepresented community in the United States has reached 50%. The company also comes down hard on anything it deems inappropriate. Just ask Tony Blevins, Apple’s former vice president of purchasing who left the company last year following making a comment regarding “big-breasted women” in a TikTok video.
