Fatal Workplace Accident in Seraing: Company Negligence and Legal Battles

The accident occurred on July 24, 2018 in Seraing. Tarek Ghabara, a forty-year-old who worked for the company specializing in sorting and recycling wood, was hit and crushed by a bulldozer while crossing a track.

The investigation highlighted shortcomings on the company’s site, in particular the lack of separation between the path used by construction equipment and pedestrians.

The investigation also highlighted the absence of a risk analysis, the medical incapacity of the bulldozer driver and an absence of a device improving visibility. The driver was traveling with the tipper raised and did not have frontal visibility over a distance of 11.8 meters.

At first instance, Léon Van Rymenam and his company were found guilty of manslaughter and various offenses. Fines of 4,800 euros and 24,000 euros, all suspended, were imposed. The prosecution requested confirmation of these sanctions before the Liège Court of Appeal.

The defense lawyers contested the accusations, stating in particular that the victim had caused the accident by his sudden movement, crossing the road while he was having a heated conversation on the telephone.

The case might also have significant civil repercussions. The victim’s family claimed damages of 31,800 euros. The judgment is expected on December 14.
