After years, Brazil moves towards regulating sports betting

The Federal Government has been moving forward over the months to regulate sports betting in Brazil. This is an issue that has been gaining urgency for a long time. It gained more attention following investigations into football players who allegedly received money from bettors to manipulate some matches.

On July 24th of this year, President Lula signed the provisional measure (MP) and the bill (PL) that regulates betting. Now, betting operators will have to follow a series of guidelines. One of them is to be taxed at 18% of the revenue. This point has been generating complaints.

Giving predictions on sporting events has become increasingly common among Brazilians. As a result, betting apps have become highly popular among fans in recent years.

Taxation

As previously stated, the government expects betting companies to be taxed at 18%. They ask for a reduction in the percentage, to between 8% and 10%. Deputy Adolfo Viana, leader of the PSDB, is the author of the bill that regulates the taxation of sports betting.

According to the parliamentarian, the 18% tax rate will be maintained. This amount collected will be used as follows:

  • 10% goes to social security;
  • 0.82% go to basic education;
  • 2.55% goes to the National Public Security Fund;
  • 1.63% go to football clubs, as they give up their names;
  • 3% goes to the Ministry of Sports.

The expectation is that with the regulation, the Federal Government will be able to raise R$700 million. However, this value might be even higher, reaching R$12 billion.

Next step in regulation

Now, Bill 3626/23 will be analyzed by Senate parliamentarians. The PL was previously approved in the Chamber of Deputies. After full approval by the National Congress, it will be up to President Lula to sanction it or not. Everything indicates that he will sign the regulation.

With the regulations coming into force, the government will have another source of revenue. This money raised can be applied to other areas and sectors of society, as explained. Furthermore, it is much easier to monitor and identify any type of fraud and irregularity in the practice of sports betting.

It is important to mention that sports betting is free on the internet. This is because operators that operate in the Brazilian market are not registered here. This release mentioned above has been allowed since 20181, when the then intended Michel Temer signed law 13.756/18.
