A man surrounded by the police, who shows no resistance in the images we were able to view, and a police officer who attacks him before delivering a blow with a baton which is dodged by the arrested man. The latter will not avoid the other blows delivered by the police before collapsing and suffering a few final impacts. In any case, this is what we can see in a video published on Instagram by the media “Bruxelles Dévie”.

So what happened this Sunday, October 22 around 5 p.m. in Rue de la Charité, a stone’s throw from the Gare du Nord? “Our patrol was stopped in the Northern Quarter by a witness who saw a person in possession of a large knife on Rue des Plantes, reports the Brussels-North police zone. When the police arrived on scene, they found the suspect in a prayer position on the public highway. He fled at the sight of the police. During his escape, he threw several knives. The suspect will be surrounded and arrested by several patrols at Rue de la Bienfaisance. During this intervention, the suspect refused several times to comply with the police’s orders. They will first use, without effect, the spray, then the telescopic batons.”

In total, four knives were found, either on the individual or thrown during his trip. According to the authorities, the suspect threatened and beat the police officers throughout his procedure which ended in a closed center, the man being undocumented.

On instructions from the Public Prosecutor’s Office, the suspect was deprived of his liberty, then judicially acquitted following his hearing and the initial investigative duties carried out. The judicial investigation continues.

The area will study the images

One question still remains: that of the use of force. In the video posted on social networks, we see the violence and the recurrence of baton blows given by the police. In fact, the man arrested did not seem threatening towards the police, nor did he offer any resistance at the time of his arrest. “The images will be analyzed by the Zonal Directorate of the Brussels-North police zone, the authorities confirm. If necessary, a debriefing and follow-up may be ordered by the Zonal Management.”

Still on the subject of images, a witness to the facts recounts the scene. “A few citizens were watching the scene, then when some took out their phones to film what was happening, the police arrived with batons to tell us to stop and leave.”

Although no blows were exchanged during this side event, it is worth remembering that filming police action is legal, under certain conditions. In the book “What rights once morest the police?”, Mathieu Beys explains that a police officer can ask not to film the scene to protect the private life of the accused, if it is necessary for the maintenance of order public or if police officers fear for their own image rights. “But this does not in principle apply in the event of intervention in a place accessible to the public,” continues the author. The argument for the right to image generally opposes the right to democratic control. And in this case, it is up to a judge to decide.
