From Geneva, Juan Gasparini
The UN High Commissioner for Human Rights Volker Turk urged the Peruvian authorities to “undertake significant reforms to guarantee the exercise of human rights in the context of the protests, continue accountability efforts and enable a decentralized and inclusive national dialogue,” according to a report published in Geneva.
The document analyzes “the conduct of security forces during nationwide protests, focusing on those that took place between December 2022 and March 2023,” and summarizes that Dina Boluarte’s government “unduly restricted the human rights of protesters“.
“The security forces did unnecessary and disproportionate use of forceincluding lethal force, outside the circumstances permitted by international human rights standards,” Turk denounced. He regretted that “the use of less lethal weapons, incompatible with international standards… caused serious and, in some cases, fatal injuries to protesters”.
In this regard, the UN “registered 50 people dead and 821 injured in the context of the protests from December 7, 2022 to March 31, 2023, allegedly at the hands of security forces.” He added that “208 members of the security forces were injured.” And he said he is aware of the opening of “criminal investigations once morest 241 people who participated in the demonstrations,” without failing to note that “221 have been archived due to lack of evidence,” including 192 “detained at the University of San Marcos in Lima.” On January 21″.
“Those responsible for human rights violations they must be held accountable, through fair judicial procedures,” stressed Volker Türk. He insisted that “accountability is essential if we want to begin to heal wounds and create trust in State institutions. “The victims must receive comprehensive reparation.” He reported that his Office collaborates with the Peruvian authorities on “45 open files” on all “those killed and injured in the protests,” and provides financial support “to some 266 people to date.”
Castillo, the “poor president” who might not handle the political crisis: causes, cabinet changes and dismissal
In turn, Turk added that “on July 19 and 31, 2023, another wave of demonstrations occurred throughout Peru, in which 64 protesters and 12 police officers were injured. The indigenous communities also were subjected to multiple acts of discrimination and restrictions on the right of peaceful assembly”.
Faced with the repressive waves of the Dina Boluarte government, the High Commissioner launched more initiatives “to promote structural changes and reforms that guarantee the right of peaceful assembly and ensure that all use of force must be compatible with international human rights law“.
It also recommended “strengthening internal accountability mechanisms, ensuring victim-centered, impartial and effective investigations, and addressing the systemic and deep-rooted problems of racism and discrimination once morest indigenous peoples and peasants, who constituted the majority of the and protesters”.
He concluded that “it is essential that the complaints and concerns of the entire spectrum of Peruvian society be addressed. An inclusive national dialogue is necessary. It is the only way to move forward. Everyone needs to feel heard and represented in society to put an end to the endless political and social crises,” said Türk, along with the hope of “continuing to cooperate with the Peruvian authorities and society in general for these purposes.”
“President Castillo is kidnapped”
On the other hand, the Argentine lawyer Guido Leonardo Croxatto, who participates in the defense of the former President of Peru, Pedro Castillo, dismissed in the circumstances that ended up generating the repressive waves mentioned above, announced that the case has been presented before the UN Committee on Civil and Political Rights, which monitors compliance with the International Covenant on the matter in Geneva, made up of 18 independent experts chosen by secret vote from the 173 countries that have ratified it, to condemn Peru, and order the release of the imprisoned former president.
“The dismissal of Pedro Castillo violated the regulations of Congress and the Peruvian Constitution. It was carried out in an unconstitutional and illegal manner. The vacancy is null. Therefore, President Castillo is kidnapped After a year in prison without a sentence, they have not found a single piece of evidence once morest him,” said the lawyer, consulted by telephone.
“It is an arbitrary detention, in addition to an illegal dismissal. They do not allow him to communicate with his lawyers or with his youngest daughter exiled in Mexico. For all of this we made the presentation before the UN Human Rights Committee and also before the Committee once morest Torture of the UN”, concluded the lawyer Guido Leonardo Croxatto.
