Abdessalem Lassoued’s Asylum Journey and Illegal Stay in Belgium: Insights from Secretary of State Nicole De Moor

Nicole de Moor, the Secretary of State for Asylum and Migration, sums up Abdessalem Lassoued’s journey in Belgium.

The man, of Tunisian origin, requested asylum in Belgium in November 2019.In October 2020, he was refused“, explains Nicole De Moor. Since then, he has been staying illegally in Belgium because the return procedure which should have led him to leave the territory might not be completed.

This is firstly explained by the choice that Abdessalem Lassoued made during his asylum application not to be hosted in a Fedasil reception center. “He first indicated an address in Forest and one in Schaerbeek where he wanted to receive his mail.“, explains Nicole De Moor. It is this last address that the Immigration Office noted in the file. “All services used this address to reach this person“, says Nicole De Moor.

As he was not yet domiciled in the commune of Schaerbeek, Abdessalem Lassoued was officially registered at the address of the Foreigners’ Office, “as is done for anyone in this situation“, explains Nicole De Moor. The man had six months to officially register in the municipality of his main residence. “A person is removed from the national register following six months if they are still registered with the Immigration Office and not in a municipality“, continues Nicole De Moor. This is what happened.

In addition, the immigration services were never able to contact Abdessalem Lassoued at the address he had provided. “He never presented himself at the refugee police station, so his request for asylum was refused.“, explains the Secretary of State for Asylum and Migration. It is “a technical refusal which is not linked to the content of the file“, specifies the Secretary of State.

The order to leave the territory was sent by the Immigration Office to the same address by registered mail. “It was not accepted and was returned to the Foreigners’ Office“, concludes Nicole De Moor.

Abdessalem Lassoued was therefore staying illegally.
