For prosecutor Tim De Wolf, the new version would make it possible to effectively sanction facts that have so far been closed without further action. The project is, however, far from unanimous. In addition to the increased workload that the project entails for municipalities, certain sanctioning officials note in particular that they are not as well equipped as the public prosecutor’s office to deal with violence, being unable to hear witnesses or request additional duties.
In addition, the sanctions – fines capped at 350 euros – may seem relatively low in the case of physical violence. The Brussels public prosecutor’s office saw its staff increase from 119 magistrates to 95 during 2023, while suffering from numerous prolonged sick leave. In five years, the number of criminal cases dismissed has increased by 157%.
