Harassment Case in Namur Rest Home: Trial Update, October 23 Judgment

The acts of harassment took place between 2018 and 2020 in a rest home in the province of Namur. The defendant is a nurse and the victim was a nursing assistant in this institution, they were required to work alone at night, in pairs.

The defendant believes that a rapprochement took place between him and the victim during the Covid period and that the young woman would have asked him to massage her. He confirms having inserted a finger into her vagina, “in order to check if she was a virgin”, and that she was consenting. A similar scene took place on the night of December 11 to 12, while she was asleep. The victim’s counsel specifies that she has been incapacitated since the events and suffered a disability of 66% following the following-effects from which she suffered.

The Namur public prosecutor’s office requires a prison sentence of 5 years. “Numerous witnesses in the case confirm that the victim had been harassed for several months by the defendant and that she did not want to go any further with him, that the latter demonstrated an unhealthy curiosity regarding the sexual orientation of his victim. Today he does not question his behavior, stating that the victim consented.”

The defendant’s counsel states that the penetration was consensual and that the victim behaved in an exuberant manner and played games of seduction with other male colleagues. Acquittal is pleaded.

The judgment will take place on October 23.
