When can a result be expected?

Once all polling stations in each state close, the major US television networks publish their forecasts. They rely on voter surveys following voting, initial vote counts at polling stations and telephone surveys.

This year, however, the task is made more difficult by the fact that voters are voting by mail in record numbers because of the coronavirus pandemic. This not only makes voter surveys in front of the polling station significantly less meaningful. Counting postal ballots also takes longer than counting votes cast at the polling station.

In some states, mail-in votes will also be accepted days following Election Day if they have a postmark of November 3rd. This is the case, among other things, in highly competitive Pennsylvania.

So broadcasters have to be extremely careful regarding when to declare a winner in a key state with a close race – and when to declare the overall winner of the presidential election. If the election outcome is very clear, this might happen on election night. But it might also take several days.

What happens following the election?

The prospect of legal disputes contributes to the uncertainty. Both candidates might contest the election results, and there is a risk of a real wave of lawsuits that – as in the election in 2000 – might go all the way to the Supreme Court.

Otherwise, the timetable is set: the electors are supposed to cast their votes on December 14th. The US Congress is scheduled to count and confirm these votes on January 6th. The election winner is scheduled to be sworn in as president on January 20th.
