Deciphering the social protection of health professionals, with Jérôme de Villèle, general director of AMPLI Mutuelle.

What is the point of taking out a welfare contract for a self-employed healthcare professional?

Jérôme de Villele: The pension contract allows liberal professionals to ensure the payment of financial assistance for himself or his loved ones in case incapacity for work, disability or even in the event of death. But life’s ups and downs don’t just happen to other people. The tensions in the health system and the Covid episode have, I believe, made everyone aware that we also had to consider that a career might be disrupted by unforeseen events. It is therefore essential that self-employed health professionals take care to protect themselves once morest the vagaries of life.

Let’s take the example of one of our members who developed anxiety-depressive symptoms during 2019, at the age of 58, which turned out to be early-onset Alzheimer’s a few months following. Since this event, his pension contract covers his work stoppages, due to his incapacity to work, in the form of daily allowances, in addition to what his compulsory scheme pays him. Her contract will then also cover her disability if she is unable to re-practice her profession.

Thanks to the guarantees that she has chosen precisely in her pension contract, she will have additional income which will allow her to maintain her purchasing power and ensure the continuation of her children’s studies. She will thus be able to meet the financial obligations she previously had. Her pension contract is there to support her and avoid a significant loss of income, because unfortunately her primary fund does not completely cover her.

The pension contract plays an essential role because it offers financial protection in the event of unforeseen events or difficult situations.

What does the compulsory scheme guarantee in the event of illness and the role of the pension contract?

Jérôme de Villele: As a reminder, since July 2021, in the event illness, accident or hospitalizationlThe liberal professional will be able to receive daily allowances from 4th au 90th sick leave day (if he contributes to a professional fund affiliated with the CNAVPL).

The amount of this daily allowance will be equal to 1/730th of the average income taken into account for the calculation of the insured’s health insurance contributions for the three calendar years preceding the date of work stoppage, within the limit of three times the annual social security ceiling (PASS) in force on January 1 of the year for liberal professions covered by the CNAVPL, i.e. with a minimum of €24/day in 2023 and a maximum of €180.

For examplewith an average BNC of 40 000€this compensation would therefore amount to €54.79/day, i.e. €1,643 per month. Taxable income, thus reduced by 50% during a difficult period, does not make it possible to both maintain one’s standard of living and meet one’s unavoidable expenses. At 91th day, depending on their profession and professional fund, the compensation will be recalculated for a period and an amount varying depending on the fund.

A pension contract allows here to provide for the payment of daily allowances for supplement income during the period of sick leave. The amounts and durations will be adapted to correspond as closely as possible to the coverage necessary throughout the incapacity for work.

The pension contract can also take into consideration part of the income normally collected during periods of activity, and thus make it possible to provide additional financial assistance to the healthcare professional who is unable to work, to cover the firm’s unavoidable expenses in his absence. .

And in case of disability?

Jérôme de Villele: In this case, the compulsory regime, once more, varies from one professional fund to another depending on the profession practiced. The amount of the disability pension can thus depend on the level of disability, be reduced below 100% disability, increased for dependent children or conditionally for the spouse. The annual annuity amounts never cover working income. The needs of the household, however, are at least equivalent.

Let’s take as an example a 45-year-old nurse with 100% disability or professional incapacity. She will receive from her compulsory scheme a gross annual pension of 20 160 € increased by €6,048 gross for spouse and dependent children. But if the professional incapacity is partial but greater than or equal to 66% et results in a two-thirds reduction in activity et if professional income is lower than a ceiling set by the Board of Directors of your professional fund and calculated personally, the disability pension will then be 10 080€without surcharge.

A pension contract will allow you to receive an additional pension to that of your compulsory plan in the event of a disability situation. The disability annuity of the provident contract must therefore provide coverage from a disability rate of 33%, rather than 66%, and can thus supplement the benefits of the compulsory plan when necessary.

Please note, it is important to favor a contract whose disability rate is that of professional disability (the inability to exercise his usual profession, everything is in the “usual”), and not functional disability (inability to have a professional activity).

What happens in the event of death?

Jérôme de Villele: Here once more, in the event of death or total loss of autonomythe compulsory regime varies, and will take into account depending on the funds the age of the deceased, the dependent children and their age, the spouse and his age also to define a capital or an annuity to be paid to children and/or surviving spouse. The loss of means for loved ones and family in the event of the death of the liberal professional will be significant in addition to a difficult mourning situation.

I suggest here that you take the example of the death of a practicing liberal doctor. Its compulsory scheme will pay:

  • a capital of €60,000 to its beneficiaries,
  • a spouse’s pension: from €7,020 to €14,040/year (depending on the doctor’s income from class A, B, or C), increased by 10% if 3 children are the result of this union,
  • an annual pension for each child of €8,268 (under 21 years old or 25 years old in the case of continuing studies).

A pension contract will make it possible to plan capital and/or an annuity for their loved ones who will supplement the benefits of the compulsory system to continue to support them. Children’s studies can thus be ensured, for example, thanks to an annuity which would be paid to them in addition to that of the compulsory system.

Hence, in short, the issue of contracts adapted to everyone and adjustable…

Jérôme de Villele: Yes. As you will have understood, not providing income coverage in the event of incapacity to work, disability or death can have serious consequences for the liberal professional or their loved ones. If he dies prematurely, loses all autonomy or is disabled or unable to exercise his profession, having subscribed to a pension contract will be the guarantee of financial support necessary for himself or his family.

The other lesson from this point is the observation that the social security coverage of health professionals varies depending on the profession exercised and therefore the professional provident fund to which they are necessarily affiliated. The first thing to do for the health professional is therefore to understand and evaluate the basic coverage he benefits from (thanks to the contributions he pays to his compulsory plan).

The second step consists of identifying the guarantees to which he should subscribe to supplement the services paid by him in order to achieve the security he wishes to benefit from in the event of hazards.

A pension contract must therefore adapt as closely as possible to each person’s professional and personal situations, by offering “adjustable” guarantees to each person’s needs. It must also evolve at the pace of the liberal professional’s career so that its guarantees remain relevant and adapted to their personal and family situation.

At what point in your professional life should you take out a pension contract?

Jérôme de Villele: The most important thing is to take out a contract when you are in good health! This avoids medical questionnaires, additional premiums in the event of pre-existing illness or even surveys in the event of illness just following membership.
