More than ten months following the fatal crash on the road to the Altas Cumbres, this Tuesday they met details of the accidentological expertise of the accident which starred the legislator in use of license Oscar González.
The report indicates that, prior to the collision, Oscar González would have surpassed at least two vehicles with the BMW X1 in a sector where a continuous double yellow line is located.

While, Alejandra Bengoa (who died in the accident) would have committed an infraction by passing a truck driving the Renault Sandero in which he was traveling with his daughter and a friend. As detailed, the Bengoa overpass occurred between 236 meters and 820 meters before the crash.
The data of the official expertise has important differences with those of the complaint expertise. Prosecutor Analía Gallaratto must analyze the reports and issue a conclusion in this regard.
Key part of the expert report:

An attempt is made to establish, with the filming data, the estimated travel time and average speed to the place of the accident.
A new key image is added to the trial for the Tragedy in the High Peaks. You can see the video of the security cameras of the toll on the Córdoba – Carlos Paz Highway where the passage of the BMW vehicle driven by Oscar González, the 74-year-old provincial legislator on license, accused of Manslaughter, is observed.
Oscar González’s mansion in San Javier is listed in the Cadastre as “wasteland”
In the images that transcended, the time the truck passed can be seen: 2:27 p.m. on October 29 of last year.
In this context, this new video was released this Tuesday, which might be incorporated as another piece of evidence to what the Justice is already accumulating while investigating the case.
The footage shows the legislator crossing the toll booths on the Córdoba-Carlos Paz highway, which also shows the time and moment he is driving there. In this way, establishing the distance from that place to the crash, an average speed might be assumed at which he was traveling on the González route.
The main difference between the experts in the complaint and the defense lies in the speed at which the vehicles were traveling, according to the lawyer Emiliano Binante, representative of the Bengoa family, when consulted by ElDoce.tv.
Another legal setback
The Federal Court of Appeals rejected that the case for the use of the BMW X1 truck go to the provincial Court, as requested by the defense of the former provincial official with the clear intention of blocking the prosecutor Maximiliano Harabedian. The ruling handed down this Tuesday by Judge Graciela Montesi revoked the resolution of Federal Court No. 1, which in April of this year had declared itself incompetent in the case.

González’s defense lawyers requested that the case go to the provincial courtsrequest that was accepted by Judge Sergio Pinto who intervened as subrogator in Federal Court No. 1. The Federal prosecutor appealed that resolution and the Chamber agreed with him this Tuesday. “The crime of unfaithful depositary for which the investigation began is related to the irregular use of a vehicle that was seized in a federal case,” argued the prosecutor, considering that the case should continue in the federal courts.
The chambermaid agreed with the grounds of the prosecution, considering that the vehicle in which González was traveling should be at the disposal of the Federal Justice. She also asked to investigate possible money laundering.
Irregular use of the vehicle
The BMW that legislator González was driving was prosecuted. She had been kidnapped in the framework of an investigation originating in Villa Dolores.
That file originated in the Provincial Justice but later the competition passed to the Federal Justice. However, the vehicle remained in the possession of the Superior Court of Justice (TSJ) of Córdoba, which in turn ceded it to the Legislature for public use.
After the tragedy in the Altas Cumbres, the federal prosecutor’s office began to investigate González as an alleged unfaithful depository. They considered that the Peronist leader, then provisional president of the Unicameral, was making improper use of the truck.
