A Styrian doctor was convicted on Friday in the Graz Criminal Court for several violations of the Narcotic Drugs Act. He is said to have offered or given cannabis to three of his four children. The accused was sentenced to a suspended prison sentence and a fine in 2019 for torturing and neglecting his children. The narcotics case was eliminated in the previous proceedings. The judge did not impose an additional penalty.
Already convicted twice
The general practitioner’s case has been dragging on for years: in 2017 he had to answer in court, but was acquitted of the charge of torturing his children. The verdict was overturned, and the second edition took place in 2019, this time with a conviction. The second verdict was four months conditional imprisonment and a fine of 1,920 euros. At the end of 2020, the higher regional court increased the fine to 7,200 euros during the appeal hearing. A conviction because of the weapons law was added, all of which is now final.
Cheese poplar tea or marijuana?
The narcotics part had been eliminated from the proceedings, which Judge Hanspeter Draxler now took up. According to the accused’s children, he offered them marijuana. Once by phone, once a herb in a plastic bag that the daughter is said to have taken and smoked. “She’s gotten sick,” said the doctor and laughed. According to him, the bag contained poplar tea with peppermint leaves. “I just wanted to test my children,” was his justification, following all there were major problems with one daughter because of her drug addiction. “Isn’t it unusual for a father to offer to buy something for his children when you suspect they have a drug problem? Why didn’t you say not to do that?” the judge wondered. “They would have just laughed at me,” the doctor replied.
Richter believes the children
“The children say he offered them cannabis and consumed it himself. That there is a big intrigue behind it is probably just an allegation,” public prosecutor Christian Kroschl was convinced. “I have nothing to do with drugs,” said the accused.
The judge believed the children’s statements to be credible and sentenced the doctor. He refrained from imposing an additional sentence, so it remained conditional at four months and 7,200 euros for torturing and neglecting the children, violating the Weapons Act and violating the Narcotics Act. The accused asked for three days to think things over, the public prosecutor made no statement, so the judgment is not final.
