The Corregedoria of the City Council of São Paulo decided that councilor Camilo Cristófaro (Avante), accused of racism, be impeached for breach of parliamentary decorum. The body accepted the vote of the case’s rapporteur, councilor Marlon Luz (MDB), in a meeting this Thursday (24).

Of the 7 legislators, 5 were in favor of losing Cristófaro’s mandate. They are Alessandro Guedes (PT), Aurélio Nomura (PSDB), Danilo from the Health Post (Podemos) and Silvia from the Feminist Banquet (PSOL). Only Sansão Pereira (Republicans) disagreed.

“I am in favor, yes, of a penalty, but not of impeachment. Every penalized person needs to be given the opportunity to prove that he has changed. In cassation there is no way to prove that the person has changed. For this reason, my vote is abstention”, said Pereira.

Guedes was once morest the removal and clarified that his vote was taken following a decision by the PT bench.

The Chamber’s auditorium brought together hundreds of people, including supporters of Cristófaro and those in favor of Marlon’s report. There were boos and applause for every vote, but the session ended peacefully.

The president of Corregedoria, Rubinho Nunes (União Brasil), would only vote in case of a tie.

The disciplinary process has been going on for one year and three months. In May of last year, Cristofáro said “it’s a black thing”. He claimed he was referring to the color of a car, and later claimed it was a prank on a friend.

Witnesses for the councilor’s defense reiterated that the sentence had been directed at his friend Anderson Silva Medeiros. However, Marlon was not convinced.

“The councilor reinforced the socially abhorrent perception that black people are necessarily in charge of performing manual work”, wrote the rapporteur.

This Thursday, hours before Internal Affairs began to decide the future of Cristófaro, there was a protest in front of the Chamber building, in downtown São Paulo.

To mobilize the population, entities launched a portal (racismonaoebrincadeira.org) with a petition and data on racial crimes, in addition to informing the email of all members of the Corregedoria so that they might be pressured.

“We already had cases of Vini Júnior and bloggers, who gave bananas to black children, we saw the population become aware. Removing the mandate is the least in light of what has been said,” said Guilherme Montenegro, from Minha Sampa, the organization leading the campaign.

Now, the report with the impeachment request will be sent to the CCJ (Constitution and Justice Commission). The latter will have three days to prepare an opinion on the draft resolution and send it to the mayor, Milton Leite.

From there, Leite can guide the case in the next plenary session. Influential councilor, Leite articulated the impeachment and even participated in protests once morest the councilor’s attitude last year.

The expectation is that the impeachment process will be judged in less than two weeks, before the September 7th holiday.

In the Plenary, Cristófaro will have two hours to defend himself. To save the term, he needs at least 36 votes among the 55 councillors. The impeachment is almost inevitable and, confirmed, it will be up to substitute Adriano Santos (PSB) to take over the vacancy.

In addition to losing his mandate, Cristófaro should remain ineligible for eight years.

In court, he was acquitted in July of this year, but the Public Ministry appealed the decision. Judge Fábio Aguiar Munhoz understood that the councilor’s speech was taken from a context of “joke, joke, but never from a context of segregation, discrimination or anything like that”.

To Folha de S.Paulo, at the time, Cristófaro said that “justice and truth won”.

Since 2017 in the Chamber, Cristófaro has accumulated accusations, disaffections and controversies. In 2019, he called councilor Fernando Holiday (Novo) an auditorium monkey. The year before, he rolled his eyes referring to councilor George Hato (MDB), who is of Japanese descent.

Folha de S.Paulo also showed, in May 2022, that the councilor is accused by nursing assistant Dilza Maria Pereira da Silva of racial slurs. The case is pending in court.

In March of that year, he would also have called a woman a slut during a visit by Mayor Ricardo Nunes (MDB) in the Parque Bristol neighborhood, as she said in a police report. “This is a lie, you have a video that shows [a confusão]?”, said the councilor to the report on Saturday, before hanging up the phone.

Even in the past, Cristofáro was involved in discussions with Adilson Amadeu (União Brasil) in the WhatsApp group with other legislators.

In his first term, he had already been impeached following the Chamber complied with a decision by the Electoral Court. According to the Electoral Public Prosecutor’s Office, he would have used resources of illicit origin in the campaign. Cristofaro, however, obtained a favorable decision in the STF and returned to the House.

In the first session, he referred to councilor Thammy Miranda (PL) in the female category. “Greet Thammy, whom I saw born, daughter of Maria Odete”.
