As reported by the OÖN, the 38-year-old had to answer to the jury on Thursday morning. But unlike before with the police, the accused in the jury courtroom in Steyr then no longer confessed. The 38-year-old claimed that he was “forced” by the police to testify that he only admitted the allegations in order to avoid being held in custody and to be able to return to his girlfriend, who was heavily pregnant at the time. He has “no idea” why the girl is accusing him.
The assembly worker is responsible for caring for a child born in December of the previous year. He has 16 previous convictions, mainly for property crimes, in 2003 he was convicted of assault.
The accused has known the victim’s mother since 2013. They both met while playing darts, and they had a “better acquaintance,” as it was said. They didn’t live next door, but in the immediate vicinity. The man from Steyr regularly looked following Laura (name changed, note), who was five years old at the beginning, and picked her up from the following-school care center. The sexual assaults are said to have happened in his home or in his mother’s home.
“Mentally Destroyed”
For a court expert who specializes in testimony psychology, the descriptions of the girl, who was five years old when the alleged assaults began, were “logical, coherent and detailed”. The child described the accused’s condoms as “rubber rings” and the girl was also familiar with lubricants. It was very scared and screamed for its mother.
The child’s mother said she didn’t notice anything, but then Laura didn’t want to visit the neighbors anymore. Her daughter is “mentally exhausted”.
The defense attorney emphasized that the allegations once morest his client contradicted his previous life. Because the 38-year-old has only been found guilty of property crimes, but never of sexual offenses.
But in the end, the Senate had no doubts regarding the 38-year-old’s guilt: he was sentenced to nine years in prison for aggravated child abuse, rape and other crimes, once morest which the accused appealed the amount of the sentence. The public prosecutor’s office also announced an appeal because, in their view, the nine years were too short. The judicial decision is therefore not final.
