Third wolf shot in Tyrol according to new regulation

In Tyrol, a wolf has been shot for the third time in accordance with the Measures Ordinance of the black-red state government, which came into force this spring. The predator was killed once more in East Tyrol, the country announced on Wednesday. The wolf will be taken to the Agency for Health and Food Safety (AGES) in Innsbruck for examination, it said. Two wolves in East Tyrol and one in the Innsbruck Land district had been “taken” since July.

Where exactly the wolf was shot in East Tyrol was not disclosed by the state in order to ensure the hunter’s anonymity. “The third shooting of a wolf within a few weeks shows that the path taken by the state of Tyrol is having an effect,” said the responsible deputy governor Josef Geisler (ÖVP). The primary goal is “the safety of people and the protection of our alpine farming.”

The predatory wolf regularly causes emotions to run high in Tyrol, and farmers complained regarding countless sheep being killed. There has also been repeated talk recently of increasing uncertainty among the population regarding wolves (and bears). In February, the majority of the state parliament passed an amendment to the law that would allow killing by decree and no longer by notice. Previous decisions had been overturned by the court several times following environmental protection organizations had successfully appealed them. The shooting ordinance now applies generally to a wolf – and not to a specific individual. There have been repeated calls in Tyrol for a reduction in the protection status of the predator at European level, for example from Governor Anton Mattle (ÖVP).

Experts questioned the legality of the approach chosen by the state of Tyrol, among others. The two European law experts Walter Obwexer and Peter Hilpold, who teach at the University of Innsbruck, had described the state government’s approach to the APA as clearly contrary to EU law. For Hilpold, the problems are “probably accepted”, Obwexer suggested a return to the notification variant. The coalition members of the ÖVP and SPÖ had also admitted a “legal border crossing” in their approach in the course of the amendment to the law.
