A group of lawyers denounced today the judge of the Federal Chamber of Cassation, Ana María Figueroa, of course “abuse of authority” and “violation of the duties of a public official”, among other crimes, as a result of his alleged intention to continue in office following reaching the mandatory age to retire pending approval from the Senate, but without sign rulings.

The Chamber of Cassation must resolve the request of prosecutor Mario Villar to annul the dismissal of Cristina Kirchner and send her to trial in the Hotesur-Los Sauces case. The Vice President has insisted on the need for the Senate to endorse Figueroa’s permanence in the Federal Chamber of Cassation.

Days ago, the senator of Río Negro, Alberto Weretilneck, confirmed that he was not going to accompany any session to appoint judges before the PASO, for which reason it left the ruling party that sought to approve 75 judicial documents, among which was that of the judge, without a quorum Figueroa.

Mauricio Macri’s request that Weretilneck not support the appointment of any magistrate in the current situation was interpreted by Cristina Kirchner as a “mafia squeeze” on the part of the former president.

“As reported by various journalistic media that cover the atypical situation, the magistrate would have made statements, that despite continuing as a vocal member” of Cassation, “I would not sign resolutions from August 10 and I would not request a license either,” summarized the complaint.

Lawyers warn of possible crimes

Lawyers Jose Magioncalda, Pedro Pusineri, Juan Otegui and Juan Fazio, from the group “Constitutional Block”, They estimated that “if said plan is carried out” it might be before possible crimes and asked for an investigation to be opened.

«It is the duty of a magistrate to know, participate in hearings, agreements, fail, found and of course, sign all jurisdictional acts of the function in charge“, they maintained.

The “arbitrary, total or partial omission of its exercise would constitute a breach of duties of the public function,” they added.

The complaint was filed for the alleged crimes of «Abuse of authority and violation of duties of a public official, denial and delay of justice, usurpation of authority”.
