Facebook condemned to pay up to R$ 5 thousand to victims of data leaks in Brazil

Facebook was ordered to pay BRL 20 million in collective moral damages for several leaks of data from users of the network, Messenger and also the WhatsApp application.

The sentence was issued by the 29th Civil Court of Belo Horizonte, and the lawsuit was filed by the Instituto Defesa Coletiva. In practice, Meta – owner of the social networks – will need to indemnify each Brazilian user in BRL 5 thousand for individual moral damages.

For this, the user needs to sue the company and prove that he used the network in the years 2018 and 2019, that is, when the data leaks were recorded.

Lawyer Lilian Salgado told O Globo that, to prove the use of the network, it is enough to have prints of the timeline and a report with the history of activities. In the case of WhatsApp, conversations in the application can already serve as evidence.

As there are two actions, the user can be indemnified up to R$ 10 thousand.

Armed with this information, the user can now file an enforcement of a collective judgment to be entitled to compensation. However, as Meta has not yet been notified of the decision, the company has not issued any position on the matter.

In addition company can also appeal judgment in higher courts.

Brazilian justice condemned Facebook in two cases of data leakage. The first took place in 2018 when hackers managed to access data such as the name, phone and email of more than 15 million users.

In May 2019, a new leak exposed the passwords of over 22,000 accounts. This action also mentions a WhatsApp vulnerability that allowed the installation of malicious apps on the victims’ cell phones.

Finally, December 2019, it was revealed that user photos, even those uploaded and unpublished, were also leaked.
