The framework that federal Justice cannot unlock to judge the Saillén and the Catrambone

For years, the authorities of the Single Union of Waste Collectors and Sweeping of Córdoba (Surrbac) and several of their relatives have been prosecuted within the federal courts. However, despite the fact that there are sections of the investigation that are ready to be brought to trial, that instance is delayed. It has been more than a year and a half since one of the cases was brought to trial and, despite that, the proceedings are paralyzed.

The different criteria between the Federal Oral Court No. 1 (TOF1) of Córdoba, the judge and the investigating prosecutor make the file jump from one side to another and cannot move forward. Meanwhile, those involved continue without any of the causes that have them as defendants taking a decisive step.

Between February and March 2022, when everything seemed to indicate that one of the files for fraud due to fraudulent administration and other crimes seemed to be heading towards trial, a series of disputes developed between the TOF 1 and the then investigating judge (now retired) Ricardo Iron Busts.

The members of the trial court declared the nullity of the proceedings and refused to carry out a trial that they intend to unify the causes that mainly involve the highest authorities of the union, Mauricio Saillén, Pascual Catrambone and Franco Saillén, son of the former.

Then, Bustos Fierro rejected that annulment and insisted that this section of the investigation has to go to trial because it has already been confirmed by the Federal Chamber.

But from the TOF1 they insisted once more that the investigating judge must conclude all the lines of investigation, group them and send them to trial so that they can air them in a public hearing.

Bustos Fierro also disagreed with the prosecutor investigating this case, Enrique Senestrari, whom he blamed for the delays in making “breakdowns” that supposedly complicate the processing of the files and leave proceedings open that, he said, delay the end. of (all) the investigation.

The 19 accused of being part of an illegal association that commits presumed crimes such as money laundering, fraud and usury with Surrbac money have yet to go to trial despite abundant evidence gathered.

There is talk of a punctilious criterion of the court that indicates that the trial must be carried out with “everything ready”, which clashes with the frequent opening of new lines of investigation that the same dynamics of the investigation continues to discover. If these two tendencies continue to disagree, it will be difficult for “the” trial to take place.

Senestrari has denied that he is responsible for the delays and charged once morest who was the judge, Bustos Fierro, who did not prosper – he indicated – investigations of garbage collection once morest municipal officials.

The TOF1 criteria seems difficult to settle because its “superior” is not the Federal Court of Appeals of Córdoba but the Federal Court of Criminal Cassation.

In turn, there are pending actions in the Cordoba Chamber that since last year must resolve an appeal to advance in other sections of the investigation for corruption in Surrbac. If that is confirmed, the unification would be closer.

Missing judges

In turn, the reality of the federal courts slows down some processes.

On the one hand, both rooms of the Federal Chamber are incomplete following the death of Luis Rueda and the recent “removal” of Ignacio María Vélez Funes.

Something similar happens with the oral courts, both needing to summon a “foreign” member to join. TOF 1 lost Carolina Prado in this case due to withdrawal, while in TOF2 the vacancy left by the retirement of Carlos Julio Lascano was not filled. On the one hand, there are Jaime Díaz Gavier and Julián Falcucci; on the other, María Noel Costa and José Fabián Asís.

These are some of the reasons why these trial courts reject the “parts” of investigations, in addition to ensuring a greater guarantee of the rights of the accused.

If there were a third court, like the one already created and designated TOF3, things would be quite simplified. Everything is ready, but it doesn’t work. The TOF3 has its judges, Cristina Edith Giordano, Facundo Zapiola and Ángel Francisco Andreu, appointed by competition.

The headquarters of this “brand new” court is also ready, a property that is already rented in the charming and comfortable Cofico neighborhood, in the north of the city of Córdoba.

What is missing then for it to start?

Some assure it, but it is hard to believe: the furniture so that the files and the personnel can function. For that, authoritative sources say, several tens of millions of pesos are necessary, something that is not easily achieved today.

Meanwhile, the situation of 19 involved in the Surrbac case, particularly the authorities of this union, remains unresolved. They may want to defend themselves in court, but cannot.
