A US federal judge has banned several agencies from influencing online platforms to curb certain content.
Two conservative US states saw the cooperation between federal authorities and online platforms in the fight once morest questionable content as a censorship campaign – and went to court. Now a federal judge is in favor of the plaintiffs – and severely restricting the Biden government’s room for maneuver.
There is “considerable evidence” of a widespread campaign of censorship by President Joe Biden’s administration, said Justice Terry Doughty of Louisiana in his justification. He agreed with a lawsuit filed last year by the Attorneys General of Louisiana and Missouri.
They accused the federal government of having exceeded its powers when trying to convince internet platforms to take action once morest posts that might have contributed to vaccination reluctance during the corona pandemic or had an impact on elections.
Judge Doughty, who restricted the Biden government’s cooperation with online platforms by means of an injunction, apparently also saw it that way. The evidence traces a fast-moving dystopian scenario, he wrote.
“During the Covid-19 pandemic, a period perhaps best described as one of widespread doubt and uncertainty, the United States government appears to have assumed a role that rivals that of Orwellian ‘Ministry of “Similar to truth,” Doughty added, referring to George Orwell’s novel “1984” regarding a totalitarian surveillance state.
Several agencies, including the Department of Health and Human Services and the FBI, fell under the injunction. All discussions with social media companies aimed at “encouraging, soliciting, or inducing in any way the removal, deletion, suppression, or dismantling of content that includes protected free speech” are prohibited, Doughty wrote.
At the same time, there are exceptions when it comes to informing platforms regarding contributions to criminal activities and conspiracies. The same applies to content that indicates a threat to national security or other dangers.
