ÖOC dispute: A decision, a winner, but no rest

The election proposal for the ÖOC board was rejected. President Stoss has prevailed, but now a wild legal battle is looming.

What happened on Monday morning in a luxury hotel in Vienna will keep the local sports scene and lawyers busy for a long time to come. The facts in short: The ÖOC has the required ao. Annual General Meeting was held and there an election list, which the board of directors around President Karl Stoss did not approve of, was put to the vote. Of the 46 of the 47 voting members (only the fencing association was missing), 13 voted in favor, 31 once morest, with two abstentions more than two thirds. At first glance, Stoss emerged as the winner from the confrontation with the “critical associations”. He will now have a new election proposal drawn up and put it to a vote in September in due time. At least that’s the plan.

What will actually happen in the next few weeks can only be guessed at. Because the representatives of the “critical associations” doubt the legitimacy of the whole event. In your opinion, the Board of Directors has not been in office since March 1st of this year and was therefore unable to convene the meeting on time or hold the election, and following the associations themselves on June 30th submitted the application for an extraordinary Annual general meeting and election have withdrawn, the whole process is of no importance.

Of course, this was contradicted by two legal representatives of the ÖOC, who were present and found the processes to be legally compliant. The lawyer on the other side was not allowed to enter the room.

However, Gabi Jahn (gymnastics), who was nominated by the critics, was allowed to present her point of view. “I wanted to explain my motives for running for office in the first place. At least I think it’s positive that everyone was asked to think regarding the statutes, because they’re just the day before yesterday.” The big question from her point of view is: “How will it be possible to form a new electoral board under these circumstances?”

Irrespective of this, both sides confirmed to the SN that they had come closer despite the complicated situation. A joint list for the September election is not out of the world – following the recent mud fight “the air is out”.
