The Council of State validated, Thursday, article 1 of the regulations of the FFF (French football federation), which prohibits “any sign or outfit ostensibly manifesting a political, philosophical, religious or trade union affiliation” in competition.
The highest administrative court in the country thus came to contradict the opinion of the public rapporteur who had come out in favor of the cancellation of this article, demanded by the collective of “Hijabeuses”.
In its press release, the Council of State “believes that the ban enacted by the FFF is appropriate and proportionate” and considers “that the principle of public service neutrality applies to sports federations which are in charge of a public service “.
“Their agents and more broadly all the people over whom they have authority must abstain from any manifestation of their convictions and personal opinions” continues the institution, for which an “obligation of neutrality also applies to all the people selected in one of the French teams during the events and competitions in which they participate”.
At the hearing on Monday, the public rapporteur considered that the obligation of neutrality might not apply to players since they do not exercise a public service mission.
The Minister of the Interior, Gérald Darmanin himself invited himself into the debate by declaring himself “very opposed” to the authorization of the wearing of the Hijab by the football players, during an interview given Tuesday morning to RTL radio.
