Privacy Disclosure Controversy: Hwang Eui-jo and the National Soccer Team’s Qualification Issue

Another issue has surfaced in the disclosure of the private life of Hwang Eui-jo (31), a striker of the national soccer team. This is because if the video taken by Hwang Eui-jo on a mobile phone is illegal without seeking the consent of the other party, it is difficult to avoid punishment by the law and furthermore, it may become a national team qualification issue.

Hwang Eui-jo said in a handwritten statement distributed through a lawyer on the 29th, “A false post was uploaded and a private life video was circulated by a person who called himself my girlfriend on the 25th, but it is groundless.” As a person, he is a criminal who defamed me with false facts and threatened me with the opportunity of possessing private videos through illegal channels.”

Hwang Eui-jo’s side has already hired a lawyer to take legal action in connection with the SNS privacy disclosure.

On the 25th, an SNS user claimed to be Hwang Ui-jo’s girlfriend, and posted some of the videos on Hwang’s cell phone on social media, exposing his private life. Hwang Eui-jo’s lawyer requested an investigation, saying, “Distributing other people’s sexual videos without their consent is a violation of the Sexual Violence Punishment Act and can be punished with up to 7 years in prison or a fine of up to 50 million won.”

Accordingly, the police assigned Hwang Eui-jo’s accusation case to the Seoul Metropolitan Government Cyber Crime Investigation Unit and began an investigation.

However, some point out that it is difficult for Hwang Ui-jo to avoid punishment by the law unless the video filmed on Hwang Ui-jo’s mobile phone was obtained with the consent of the other party. According to Article 14 of the Sexual Violence Punishment Act, filming the other person’s body without consent is punishable by imprisonment for up to 7 years or a fine of up to 50 million won.

In other words, if Hwang Ui-jo’s accused party insists that he “filmed without consent” during the police investigation, it means that Hwang Ui-jo can also be subject to legal punishment. In addition, according to Article 17 of the National Soccer Team Operation Regulations, players who have been sentenced to imprisonment or higher are disqualified from the national team, so future team activities may also be restricted. It is also bad news for the national soccer team, which aims to win the Asian Cup in January next year. The Korea Football Association said, “We are closely monitoring this situation.”
