The Chubut criminal judge Karina Breckle prosecuted today the owner of the field adjacent to Punta TomboRicardo La Regina, for the destruction of 175 Magellanic penguin nests, among which it is estimated there were at least 35 with eggs and chicks.

The judge also gave a period of six months to investigate the fact what it took place between August and November 2021 in Punta Claraan area bordering Punta Tombo where one of the largest Magellanic penguin reserves in the world is located.

The Hearing was held today at the Rawson Judicial Officecapital of Chubut, where Ricardo La Regina was accused of “aggravated damages as author” and “aggravated damages in ideal competition with acts of cruelty to animals.”

The request to open an investigation was formulated by the Attorney General Florencia Gómez.

“For this prosecution, the fact is more than proven And this is how we will demonstrate it throughout the investigation that is supported by contributions from National Geographic, scientists from Cenpat-Conicet and biologists specialized in the species,” prosecutor Gómez explained to Télam.

Destroyed 175 penguin nests: how it was done

The owner of the field is indicated to have passed above the nests with a heavy tractor to lay out a dividing fence perpendicular to the sea in an apparent family dispute over land.

The property where the research is concentrated is in Punta Clara, adjacent to Punta Tombo, an area densely populated by the species 100 km. South of the Chubut capital.

A similar hearing was held at the beginning of this year but was unsuccessful because the intervening judge considered that the prosecutor had not clearly specified the charges once morest La Regina and that affected her right to defense, for which she requested reformulation of the accusation.
