This year, Brazil celebrates a century of Social Security. It all started with the Decree no. 4,682, sanctioned by the president at the time, Arthur Bernardes, on January 24, 1923, the system initially accommodated only railway company employees. After 100 years of advances and reforms, however, Social Security has a nationwide scope, benefiting workers from the most diverse areas. According to the BEPS (Statistical Bulletin of Social Security), publication of the Social Security Secretariat of the Ministry of Finance, the INSS (National Institute of Social Security) has regarding 37.8 million of beneficiaries, totaling more than BRL 60 billion in payments.
To apply for retirement, workers included in the General System, which is administered by the INSS, must be at least 62 years old, in the case of women, and 65 years old, in the case of men. In addition, it is necessary to have contributed for at least 15 years, in the case of women, and 20 years, in the case of men.
The INSS also offers disability retirement, which has its own rules and characteristics. This type of benefit is granted to the insured person who proves, through medical expertise, to be permanently incapacitated to perform his/her duties as a result of an accident or illness.
André Beschizza, specialist in INSS benefits, informs that there is no list of specific illnesses that automatically grant the right to disability retirement. “The expert doctor will assess whether a certain disease causes total incapacity for the activity that the insured person performs. If the loss of ability to work is verified, the pension will be granted”, he says.
He points out, however, that there are some diseases that can cause permanent disability and, following expert validation, may give the right to disability retirement. Are they:
- Mental ilnesesssuch as depression, bipolar disorder, schizophrenia and generalized anxiety disorder;
- Heart diseasessuch as heart failure, acute myocardial infarction, angina pectoris and cardiac arrhythmia;
- Respiratory diseasessuch as asthma, chronic bronchitis, chronic obstructive pulmonary disease (COPD) and pulmonary fibrosis;
- neurological diseasessuch as Parkinson’s, multiple sclerosis, peripheral neuropathy and cerebral palsy;
- musculoskeletal diseasessuch as rheumatoid arthritis, arthrosis, disc hernia and fibromyalgia;
- oncological diseasessuch as breast cancer, prostate cancer, lung cancer and bowel cancer;
- Infectious diseasessuch as AIDS, tuberculosis and hepatitis C.
Pre-requisites for applying for disability retirement are to be on sick leave and to have completed the 12-month grace period for contributing to Social Security. “There are some more serious illnesses, predicted by the Lei nº 8,213/9which waive the 12-month grace period to be entitled to the benefit, such as leprosy, multiple sclerosis, malignant neoplasm, blindness, severe nephropathy, among others”, stresses the specialist.

To apply for disability retirement, the taxpayer must schedule a medical examination by accessing the website My INSScalling the number 135 or even going to the Social Security Agency closest to your residence.
“On the day of the inspection, the insured person must take all the medical documentation that proves permanent incapacity for work, such as imaging tests, reports, reports, medical prescriptions, etc., remembering that it is the INSS medical expert who will assess whether the worker is entitled to disability retirement”, concludes André Beschizza.
