Lucas González’s family lawyer, Gregorio Dalbón, He requested this Tuesday life imprisonment for Gabriel Isassi, Juan José Nieva and Fabián Lópezthe three agents of the Buenos Aires Police brigade accused of the aggravated homicide of the 17-year-old boy and the attempted murder of his three friends, which occurred in the Buenos Aires neighborhood of Barracas in 2021. Dalbón requested a sentence of 20 years in prison for the remaining defendants for the cover-up of the crime and the illegal detention of the boys, with the exception of two agents: Sebastián Baidón and Héctor Cuevas. Baidón was pointed out by Joaquín, one of Lucas’s friends, as the one who yelled at him “black shit, you also have to shoot yourself“, for which Dalbón asked 30 years for him for the crime of torture. In the case of Cuevas, the principal who in his statement identified Isassi and Deputy Commissioner Roberto Inca as those responsible for planting the toy weapon in Lucas’s car, Dalbón He asked for three years and six months.

Pins with the face of Lucas

Héctor and Cintia, Lucas’s parents, sat in a corner of the small audience room of the Oral Criminal Court No. 25 around 11:30 a.m. this Tuesday. they were also Julian, Joaquin and Niven, the three surviving boys, accompanied by their parents. It was the first time that they might all enter the room of Paraguay at 1500 together since the court decided to move the development of the trial there, which, in its first hearings, was held in Comodoro Py. Some carried pins with the face of Lucas and an inscription with the request for justice. They held hands when the lawyer representing them announced that he would read the sentence request.

Dalbón started with Isassi, López and Nieva. He confirmed what he had already anticipated last week when he began his argument: that he considers the three as co-perpetrators of the quadruply aggravated homicide of Lucas. With that qualification, the request for grief was evident, but it did not stop moving Lucas’s family and his friends. The four aggravating circumstances listed by the lawyer were: for having been committed with treachery, for pleasure and racial hatred, for the premeditated collaboration of two or more people, and for having been committed by members of a police force abusing their duties. Dalbón specified that the The same aggravating factors apply to attempted homicides Julian, Joaquin and Niven.

“They are murderers”

“They are murderers who they wanted to kill the four and that they might not murder the other three for reasons beyond their control,” the complainant maintained in his plea, which lasted regarding two and a half hours. During his speech, the lawyer detailed the different elements that, according to what he said, prove that the three defendants they intended to kill from the moment they crossed paths with the boys’ Surán, who had gone to buy juice at an Iriarte and Luna kiosk, following leaving a training session at Barracas Central. “The one who came down was Lucas, who he had a white capand in the videos you can see how the brigade car passes them very slowly: there they chose them because of their skin color. Then they turn onto Iriarte, stop and wait for them. Why didn’t they approach them at the kiosk if they had any doubts regarding their situation?Dalbon wondered.

“At 9.39 the beginning of the pursuit is displayed. The vehicle attacks that of the victims without a beacon, without a siren and without any identification that would make one think they were police officers,” the lawyer continued, citing the statement of eyewitness Nicolás Connell Farrell, who assured that he heard a “brake” and “between seven and nine shots”that he saw the Nissan “obstructing the Suran” and that he thought it was a robbery because never heard loud voices. At that moment, Dalbón showed the section of the video in which the final moment of the persecution is observed. “The three policemen go down. They were shot from the front, obliquely and another went to continue shooting them from behind. The three pistols were used, the three hands had shot, the three went down pulling“He explained regarding the co-authorship of the crime.

Request for 20 years in prison for the concealers

Dalbón’s request for a sentence for nine of the other eleven defendants was joint: 20 years in prison. Its regarding commissioner inspector Daniel Santana, responsible for all the commune No. 4 police stations; of the curator Rodolfo Ozán from the 4A of Parque Patricios; he Commissioner Fabian Du Santos of the 4D of Barracas; he Commissioner Juan Romero of the Brigades and Summaries Division of the commune; he deputy commissioner Ramón Chocobar of the 4D; he deputy commissioner Roberto Inca of Brigades; and the officers Jonathan Martinez, Angel Arevalos and Daniel Spinosa. First of all, he accuses them all as co-perpetrators of the crime of concealment “for having helped Isassi, Lopez and Nieva to evade the actions of Justice and for having altered traces, evidence and instruments”.

Dalbón cited the call between Ozán and Du Santos as one of the key pieces of evidence in the cover-up and read the transcript during his argument, pausing at important points in the story. conversation that occurred at 9:59 that day, twenty minutes following the shooting. There Ozán, the first commissioner to arrive at the place, tells Du Santos that he already told Inca that “look for what you have to look for to justify this”. He also refers that he will call Santana and suggests that Du Santos contact Romero to tell him “what come to clean up this shit”. The lawyer stressed that in the audio all the high ranks imputed appear in the cause and considered listening as “little short of a confession of cover-up“.

The aggravating

The lawyer added two aggravating factors to the cover-up: because they were public officials and because the predicate crime, homicide, was especially serious. He also accused them for the illegal deprivation of liberty of Lucas’s friends that, being minors, they were first handcuffed at the corner of Alvarado and Perdriel, then in a patrol car and finally they spent the night at the Inchausti Institute. The accusation is also aggravated for being public officials and “because in the performance of an act of service omitted to prevent the commission of the crime of torture”.

The crime of torture was attributed especially to officer Sebastián Baidón for the screams that the boys claim to have suffered when they were handcuffed in Alvarado and Perdriel. At the second trial hearing, when the survivors testified as plaintiffs, Joaquín had pointed directly at Baidón as the author of one of those cries: “You are a black shit, you also have to shoot yourself“. Dalbón added that Joaquín “he does not forget his face anymore“Baidon.

In the case of the principal Cuevas, the request for a penalty included considerable restraint, since the complaint requested three years and six months in prison. During the plea, Dalbón repeated that believe in the version put forward by Cuevas in his investigation of the trial, in which he indicated that he saw Isassi plant the toy weapon in the boys’ car and before that he heard Inca order it with the phrase “go put that“. “The cause also contains an audio in which, without knowing that they were listening to him, Cuevas states that he saw everythingthat they did everything wrong and that the gun “was put on them,” added Dalbón.

Although the principal is the only one of the agents facing the trial he gave positive in the odoriferous expert opinion carried out on the toy weapon, the lawyer maintained that he believes in his version, in addition, because the cameras and the geopositioning data of the motorcycle of officer Facundo Torres “give me the certainty that Isassi went with Torres to look for the toy weapon“, as Cuevas pointed out in his statement. “I also believe Cuevas because I saw him remorseful and he mightn’t take it. In order to take down the mob, one of them has to crack.”Dalbon closed.
