This Monday, in Mons, was held the trial of 4 police officers prosecuted for non-assistance to person in danger. In 2016, at the Dour festival, a 26-year-old Frenchman who had used drugs was arrested and placed in a cell. His condition had deteriorated and the young man had died.
They had been waiting for this trial for 7 years. Relatives of Simon, who died in July 2016 in a police cell. That evening, he had been arrested for disturbing the public order following consuming LSD. He will remain there for 4 hours without receiving any assistance while his condition is considered worrying. Four policewomen must now answer for non-assistance to anyone in danger.
“You only have to see the images to realize when someone is alone, in a cell, naked, banging their head on the walls, drinking water from the toilet, shaking and that he convulses. Not sending a doctor seems incredible to me in a democratic society like ours”, enlightens Me Jean-Philippe Mayence, lawyer for the victim’s family.
Also in the dock is the dealer who supplied the LSD. For long minutes, the police expressed their regrets, with tears in their eyes. “We never imagined such a fatal outcome. For us, he was a festival-goer unfortunately affected by drugs, like many others”, they testified. “If she had been aware that he was in danger, obviously, as she did a few minutes earlier for another detainee, she would have called the emergency services. Which she did as soon as she saw that he was in critical condition, explains Me Frank Discepoli, lawyer for one of the commissioners.
During poignant testimonies, the parents paid tribute to their engineer son, without any background. The context is mentioned. The two parties, however opposed, approach these ubiquitous drugs. “I am stunned to see that everyone is circulating with narcotics. And sometimes, some succumb”, deplores Me Jean-Philippe Mayence.
The prosecution requested four years in prison for the young dealer and an acquittal for the four policewomen. The judgment will be rendered within a few weeks.
