The extradition trial of the Mapuche leader Facundo Jones Huala already has a date. It will be on July 3. It only remained to define the place that was already announced and generated a strong controversy. Federal judge Gustavo Villanueva ordered that the oral trial take place in Squadron 36 of the National Gendarmerie in Esquel.
Jones Huala remains detained in the Esquel federal prison following being arrested on January 30, in a house in El Bolsón.
“Trials should be held in court or civilian facilities so that everyone can witness them”, they argued from the Association of Lawyers of Argentina that assists Jones Huala.
They considered that national and provincial human rights organizations should intervene. “It will be a trial like any other, obviously conditioned because we will be pressured by an armed force, something that would not happen in a courthouse or a civilian installation ”said Eduardo Soarez, one of the lawyers who are members of the association.
From the association they stated that “both the court and the prosecutors are terrified of the Guild to produce a face-to-face trial and face us face to face.”
The Mapuche leader was sentenced by the Oral Criminal Court of Valdivia to 6 years in prison as author of the fire of a house and for illegal possession of weapons. He had been a fugitive from Chilean justice since February 11, 2022 when, following being released from prison, the Supreme Court of Chile ordered that measure to be reversed and that he return to Temuco prison to complete 6 years in prison.
Jones Huala has one year and 4 months left in prison to complete his sentence and his lawyers claim that he can serve it in Argentina. Weeks ago, they requested Villanueva’s removal for lack of impartiality, considering that he had already intervened in the first extradition trial. But the appeal was rejected.
Now they are questioning the decision that the trial take place in the facilities of a Gendarmerie squad. “The Court’s decision to isolate itself within a barracks also implies the great fear that they have of the people, of the people, of any hint of solidarity expressed in popular mobilization. They prefer the impunity that they facilitate for themselves to carry out a despicable act such as the one that will be the extradition trial,” they said from the Lawyers’ Union.
