Tero customers who have never received their composter will be able to demand a refund from the issuer of the credit card with which they paid for their purchase if their contract was concluded remotely.

The Consumer Protection Office (OPC) made the clarification on Monday, a few days following the announcement of Tero’s bankruptcy. The Quebec company, which had seduced consumers with its small kitchen appliance capable of transforming table waste into compost, aroused a wave of anger on social networks by announcing the end of its activities. Some customers had been waiting for their composter for nearly two years.

On Tero’s Facebook page, customers had indicated that they had been able to obtain reimbursement of the sums paid in vain, while others had been refused by their credit card issuer.

The OPC observes that some card issuers mention exceeding the time limits for complaints provided for in their user agreement. However, they do not have the right to evade the Consumer Protection Act, which provides the right to be reimbursed for merchandise that has not been received.

“Consumers who are refused a chargeback request are invited to file a complaint with the OPC once morest their financial institution,” said Charles Tanguay, spokesperson for the OPC.

According to documents from trustee Lemieux Nolet, Tero’s claims might amount to $6.9 million.

More than 2000 customers would not have received their device and these would have placed orders of $500 to $1500.

Tero was launched in 2019. Its Kickstarter crowdfunding campaign raised $1 million in just 24 hours. The company had also obtained the support of the National Bank and the founder of EXFO, Germain Lamonde.
