Health Canada is pleased to announce the fifth publication of the Guidance Document: Certificates of Supplementary Protection.
Effective September 21, 2017, the Patent Medicines and Liaison Office (BMBL), within the Office of Submissions and Intellectual Property, administers sections 104 to 134 of the Patent Act and the Certificates of additional protection (CPS Regulations).
A change has been made to the definition of “market authorization” in subsection 1(2) of the CPS Regulations. Guidance Document: Certificates of Supplementary Protection has been updated in accordance with this amendment and to reflect current administrative practices, such as harmonizing the definition of filing date with the Guidance Document: Management of Drug Submissions and Applications, and how to apply for a Certificate of Supplementary Protection and related correspondence.
