“Criminal sentenced to 14 years for serious sexual abuse: The role of ESI and teachers in prosecution and prevention”

Chamber 1 of the Salta Trial Court sentenced a man to 14 years in prison for considering him the author of the crime of “seriously outrageous sexual abuse due to the time and manner of commission and sexual abuse with carnal access aggravated by custody and coexistence.”

He Criminal Prosecutor of the Unit for Crimes once morest Sexual Integrity 4, Pablo Rivero, represented the Public Prosecutor’s Office during the trial and had requested a sentence of 15 years in prison.

Rivero carried out the investigation of a complaint made by the vice principal of an elementary school in the capital of Salta in April 2022. The teacher said that in a class the student body had been asked to write an autobiography.

“My autobiography. My name is …. and I was born on…. 2010 in Salta, Argentina. I am of the sign … and I do not like cheese, nor pork. When I was 5 years old my father sexually abused me, when he was 9 years old my mother took me to meet…. (my favorite city), and when the pandemic started my dad abused me more often almost every day. That’s why 2020 was the worst year of my life, when I turned 11 I told my mom what my dad did to me, she didn’t believe me and she laughed at me in my face. That’s why when I’m doing something important like my homework or anything else I get distracted because I’m constantly thinking regarding her laugh, I also have a hard time trusting others. When I turned 12, I cried because I was very afraid that he would return to my house, although my life was always sad, I always try to be happy and fulfill all my dreams,” wrote the 12-year-old girl.

Prosecutor Rivero requested that the girl be interviewed on Closed Circuit Television by professionals specialized in sexual crimes from the Fiscal Investigation Corps and to be examined by the doctors of the CIF.

The expert opinion report revealed that traumatic events of a sexual nature occurred to the girl between the ages of 5 and 10 and that she showed lack of protection from the family group. In addition, the professionals warned of the need for psychological treatment to protect her life. The medical report confirmed the sexual abuse with carnal access.

At trial, the father denied his daughter’s statement and pointed to a trip that his daughter made to her uncle’s house in Oran as the moment of sexual abuse, which was refuted by the prosecution and the experts.

In his plea, prosecutor Rivero highlighted the role of the National Comprehensive Sexual Education Program (ESI) and of the teachers within the criminal investigation of this type of crime.

Judge Javier Araniba also ordered that the sentenced person be examined by a doctor from the Judiciary to obtain his particular details and that, through the CIFDNA samples are extracted for later incorporation into the Genetic Data Bank.
