Apple again beats Epic Games in legal dispute

According to a new report by the Bloombergthe United States Court of Appeals for the Ninth Circuit rejected the claims of the Epic Games regarding the imbroglio involving the App Store. In January last year, the Fortnite developer filed a lawsuit claiming that the court had erred in concluding that Apple’s app store policy did not violate local antitrust law.

The decision published today comes only to ratify the previous one, in which the judge Yvonne Gonzalez Rogers had already stated that, although Apple cannot be considered a monopolist under antitrust laws, its behavior might be framed as anticompetitive under California’s free competition laws.

In the most recent order, the Court wrote:

There is a lively and important debate regarding the role played in our economy and democracy by online transaction platforms with market power. Our job as the Federal Court of Appeals, however, is not to resolve that debate—nor might we even attempt to do so. Instead, in this decision, we faithfully apply existing precedent to the facts.

Although this decision means an important victory for Apple, it is worth remembering that the court maintained the original order. Thus, Apple will no longer be able to prevent developers from including metadata buttons, external links or other calls that direct users to external purchase environments (outside the App Store) in their applications.

In a statement, Apple said it supports the court’s decision but does not agree with the decision on changes to the App Store. The company also said it is “considering a further review”.

Today’s ruling reaffirms Apple’s resounding victory in this case, with nine of the ten claims having been decided in Apple’s favour. For the second time in two years, a federal court has ruled that Apple complies with antitrust laws at both the state and federal levels.

The App Store continues to foster competition, drive innovation and expand opportunity, and we are proud of its profound contributions to both users and developers around the world. We respectfully disagree with the court’s decision on the only remaining claim under state law and are considering a further review.
