Theft of a car in Conakry: the Dixinn prosecution evokes gray areas in the case

Did Souleymane Sylla really steal the KIA brand 4×4 car with an estimated value of more than ninety million Guinean francs? The question is put to the court of first instance of Dixinn where his trial is being held. Married and a driver by profession, Souleymane Sylla is being prosecuted for car theft. He is accused of fraudulently stealing the KIA 4×4 vehicle belonging to his uncle. According to the explanations of the lawyer for the civil party, the defendant would have stolen the vehicle around 4 am and that he was in possession of the key.

“When the family woke up in the morning and did not find the car in the yard, they called Souleymane, he did not pick up. The family members went to his house, but he was absent, ”said the lawyer who underlined that the defendant had arranged his coup in advance. “He had contacted people. They had time to inspect the car. In his pleadings, the lawyer asked to hold Souleymane Sylla guilty, to order him to return the vehicle or to pay one hundred and sixty million (160,000,000) Guinean francs, the value of the car, plus the amount of fifty million (50,000,000) Guinean francs as damages,” pleaded the lawyer for the civil party.

For the Public Ministry, represented by Amara Camara, there are gray areas in this case. To better situate the Tribunal, he goes back to the facts. “On July 15, 2022, investigations were carried out. On July 9, 2022, Souleymane asked his uncle to lend him his car. His uncle asked that Kadiatou Bah, who is the adopted daughter of the uncle in question, accompany him. When he returned, he actually returned the key to his uncle. The next day, it is Kadiatou Bah who asks for service. She called Souleymane Sylla to accompany her (…) It was following five (5) days that Elhadj found that his car is no longer there, he informs his adopted daughter and the latter says that the key is stayed with Souleymane,” said Amara Camara. The Deputy Prosecutor believes that it is impossible for a car that we see every day to disappear without someone noticing immediately. He adds that there is doubt in this case, because according to him, the two (Souleymane Sylla and Kadiatou Bah) needed the same vehicle.

In view of these doubts, the Public Prosecutor requires: “these facts, even if they are made up, but that is detrimental to Kadiatou Bah, because it was she who last asked for service”, he said, asking thus, the application of Article 544 of the Code of Criminal Procedure, requiring the defendant to be released for the benefit of the doubt.

The Court, through President Damba Oularé, following hearing the defendant’s request for forgiveness, put the case under advisement for a decision to be rendered on May 11, 2023.
