The ÖVP partly blamed Zadic for the fact that construction sites such as the rights of the accused have not yet been completed.
The rights of the accused in the investigation are currently “very good” anyway, according to the justice minister. There is a lot of catching up to do with the police. But there were a number of proposals from her side that now have to be negotiated in the coalition. In addition, Zadic wants to wait for various supreme court decisions, for example when dealing with mobile phone evaluations.

For Zadic, the fact that the ÖVP has now “discovered” the rights of the accused is due to the fact that individual ÖVP politicians have also been accused. On the specific question of reimbursement of costs in the case of acquittals, she passed the ball on to the Ministry of Finance, which had to provide an approximate cost estimate. The Minister of Justice also sees the responsibility of the Turks in various leaks of files, which mostly come from the committee of inquiry. National Council President Wolfgang Sobotka (ÖVP) is called for here.
For the Minister of Justice, however, the most important suspect right is the disempowerment of politicians in the case of instructions to the public prosecutor’s office. A proposal from the panel of experts she convened has been on the table for a long time, but since then there has been no agreement with the coalition partner. Zadic once more pleaded for a three-person senate as the federal prosecutor preferred by the coalition partner. There will be another meeting soon, but “for my taste it’s going much too slowly”.

Edtstadler herself is waiting for the federal prosecutor to provide “concrete templates” for the accused’s rights, as she said in an interview with the “Presse” on Sunday. Regarding the implementation of the reform of official secrecy, she reported that they were “finishing it” and wanted to start negotiations with the opposition soon. “It can only be a matter of weeks,” said Edtstadler.
On the question of reimbursement of costs, the Ministry of Finance said, following Zadic’s statements, that it was assumed that the Department of Justice would bring the issue up in the next budget negotiations. With the previous budget increases, however, implementation would have been possible in the past. The responsible department ultimately decides on the prioritization of budget funds.
ÖVP General Secretary Christian Stocker also reacted. To date, the Minister of Justice has neither presented concrete proposals to strengthen the rights of the accused nor taken the necessary steps to introduce reimbursement of procedural costs in the event of acquittals.
