Rodríguez Larreta once again asked the Supreme Court to seize the Nation’s accounts

From the government of the City of Buenos Aires appeared once more today before the Supreme Court of Justice to reiterate the request for the seizure of the accounts of the National Bank. The request seeks to ensure compliance with the ruling that ordered the reintegration of part of the federal co-participation funds that the management of Alberto Fernández decided to suspend in 2020.

According to the calculations of the Buenos Aires administration, the debt for the breach of Casa Rosada has already exceeds 57,587 million pesos.

“I come to reiterate my request that the requested enforceable measure be ordered, that is, to seize daily the amount corresponding to 1.55% of the mass of funds defined in article 2 of Law 23548, lwhich must be deducted from the amount that corresponds to the Nation in the primary distribution and order the Banco de la Nación Argentina to transfer them daily and automatically to the City of Buenos Aires, together with the 1.40% that will be receive up to present”, pointed out the presentation made by the General Director of Tax Affairs and Fiscal Resources, María Cristina Cuello.

Given the persistence of the manifest breach of the defendant, I also reiterate the request for the application of pecuniary sanctions”, added the request.

The Government of Buenos Aires also requested that the authorities of the Banco Nación be intimidated “to comply with the transfers in the percentage, manner and time ordered.” They added a note in which Batakis, director of the agency, stated that “nohas been notified of any measure ordered in the process”.

The disputes between City, Nation and the Court


Last December, the Court ruled in favor of restitution of 2.95% of the mass of co-participating taxes to the capital, which were removed by President Alberto Fernández to be redirected to the Province of Buenos Aires. The highest court has yet to resolve the substantive claim.

By a decree of former President Mauricio Macri, it had established that the Rodríguez Larreta government should receive regarding 3.75% of the national co-participation.

However, the Casa Rosada never made the payment ordered by the Court effective. On December 23, the President announced that he would not comply with the ruling. Three days later, he said that he would make the payments, but not in cash and for the “daily trickle” of the co-participation, but in bonds.

The Ministry of Economy, in charge of Sergio Massa, reported that it would transfer 98,500 million pesos in Treasury Bonds (TX31) to Banco Nación to be deposited in an account in the name of the City, parto cover the difference between 1.40 and 2.95% of the partnership.

In the meantime, the City went to court once more by denouncing non-compliance with the ruling and rejecting payment with titles.

“As we anticipated, lThe only way to pay taxes is by depositing a sum of money. These taxes paid in pesos are those that constitute the co-participating mass to be distributed”, indicated the City authorities.
