Court confirmed dismissal of 13 judges accused of prevarication for revoking freedom of accused of the “front line”

The Santiago Appeals Court ratified the dismissal of judges accused of prevarication for revoking the freedom that the judge of the 7th Guarantee Court, Daniel Urrutia, issued in March 2020 in favor of 13 defendants of the so-called “front line” of the protesters who had been detained and were being investigated for public disorder as a result of the demonstrations following the social outbreak of October 18, 2019.

The resolution had been adopted by the Eighth Chamber of the capital’s appellate court, headed by Minister Alejandro Aguilar Brevis and made up of Minister(s) Viviana Loreto Ibarra Mendoza and member lawyer Michael Christian Camus Dávila.

The Court of Santiago confirmed the appealed resolution, decreed by the Seventh Guarantee Court of Santiago on December 19, 2022, which issued the final and total dismissal of the proceeding, in accordance with the provisions of the Code of Criminal Procedure regarding the fact that the investigated does not constitute a crime.

“Having been definitively dismissed the defendants, the Public Prosecutor’s Office and the complainant are sentenced to pay the costs of the procedure“, concluded the ruling.

“We are very satisfied. This is the second time that the Seventh Court of Guarantee has ruled the innocence of the court ministers and in this sense, on this occasion, not only has innocence been indicated, but it has also been ratified by the capital’s appellate court of unanimously and forcefully, expressly condemning the costs of both the Public Prosecutor’s Office and the complainant, which shows that it was nothing more than a maneuver intended to undermine the honor of the Judiciary”, stated andhe Head of Studies of the North Metropolitan Regional Ombudsman, Octavio Sufán.
