The province must compensate two victims of police violence in Bariloche

Two people who were injured in a police procedure carried out on public roads and then inside a Bariloche police station they must be indemnified by the Government of Río Negro for the damages caused to them.

The Judiciary reported -in a press release- that the case had previously had a criminal phase with convictions of two police officers and a third was acquitted for the benefit of the doubt, and in the civil phase, which Court 5 ordered, the penalty fell on the provincial State. The date of the events or the amounts of the claim were not specified. This newspaper unsuccessfully tried to access the ruling, due to the lack of operation of the official website of the Judiciary this Saturday, where the sentences are published.

As reported by the agency, in the criminal stage it was realized that the victims suffered “institutional violence in the dungeon” of the Second Police Station of Bariloche, in the Civic Center. One of them, in particular, received blows to his lower extremities and genitals, “turning his legs into a single bruise almost without interruption.”

The plaintiffs indicated in their presentation that at the corner of 20 de Febrero and Güemes, near where their car had been stranded, They were intercepted by three patrol cars. Policemen got out, opened the doors and pepper sprayed them. One of them, who identified himself, along with another cash, pulled the driver out of the vehicle, by the hair, and punched him in the jaw and in the mouth.

In this procedure, they were forced to tell them the phone passwords to delete everything they had recorded during a previous procedure, carried out by the municipality with police presence. The beatings continued to the police station. Also in the dungeon.

According to the ruling of Civil Court 5, “the facts described allow us to conclude that it was a totally irregular, illegal and violation of human rights procedure, since dignified treatment was not provided and personal integrity was not respected.”

The Compensation contemplates the psychological damage caused, loss of earnings and non-pecuniary damage.

“The existence of moral damage is evident because the spirit, tranquility and physical integrity of the actors have been affected, who have not only suffered the physical injuries described by the forensic doctor but also other illegitimate vexations and totally reprehensible in a rule of law, especially when such acts came from members of the state institution in charge of safeguarding the safety of citizens; all of which evidently had repercussions on social, work, family and recreational life,” the sentence indicated.
