Instead of a law, it is a decree that Macky Sall has taken to enforce the reduction in rental prices decided at the end of the national consultations. The Government has seized the Constitutional Council for a “delegalisation” of the 2014 law.
After its referral at the beginning of last week by the Prime Minister, it is finally today Wednesday that the Constitutional Council will rule on the Government’s request to allow the Head of State, Macky Sall, to sign the decree instituting the drop in rent prices, reports L’OBS.

In his letter addressed to the Constitutional Council, the Prime Minister clearly indicated “that pursuant to the provisions of Article 76, paragraph 2 of the Constitution, I request that the Council should declare that Law No. 2014-03 of January 22, 2014 lowering rents not having been calculated according to the corrected surface, has a regulatory nature”.
It follows, he says, that the aforementioned law n° 2014-03 of January 22, 2014 intervened in the field of regulatory power. It is therefore up to the regulatory authorities to set the terms for determining the rent, regardless of the method of calculation used (system of corrected area or percentages).

Given the urgency, the Prime Minister thus asked the Constitutional Council to rule within eight (8) clear days, in accordance with the provisions of Article 21 of Organic Law No. 2016-23 of July 14 2016 relating to the Constitutional Council.
If the Constitutional Council today gives a favorable response to the request of the Head of Government, the reductions in rental prices should take place in the hours that follow in Senegal.

According to information from L’Observateur, all the texts and regulations are already ready. And the Government will not wait a single second to apply them. To the delight of thousands of Senegalese facing financial difficulties to pay for the rental which has suddenly become very expensive in Senegal.
