Judge Ana Pérez Ballester was indicted today for breach of the duties of a public official in the context of the crime of Lucio Dupuy, since the magistrate had been the one who granted custody to the mother, the main accused of the murder. The news broke less than 48 hours from know the sentence.
The criminal complaint once morest the head of the Family and Minor Court No. 1 of La Pampa was entered by the Mas Vida Foundation. It is an NGO that defends Human Rights in the Primary Care Unit, dependent on the Public Prosecutor’s Office of the province.
“We are facing an obvious case of poor performance“, commented Raúl Magnasco, president of the complainant institution. With this resource they seek determine the guilt of the magistrate in the casefor not taking the socio-environmental precautions of the home where Lucio would finally find death.
“When custody was handed over to Lucio’s uncles, they subjected them to all possible environmental studies, but cWhen they tried to hand him over to the couple responsible for his torture and death, the judge failed to comply with the controls“, analyzed Magnasco.
For the head of the foundation, the judge’s decision “It led to the preventable death of Lucio”. “We trust that the prosecution will assume her role and that Judge Ballester will at least step aside,” she requested.
“Lucio lost his life in the worst way, but who knows how many more children are in danger at this very moment due to the actions of this judge,” he concluded.
Before the verdict
