An investigation reveals where the labor rights of MIRs are most respected.
An investigation carried out by the Collegiate Medical Organization (OMC) has made it possible to take an x-ray of the violation of the labor rights of medical residents in Spain, especially as a consequence of the overload derived from the guards. European labor legislation is not fully complied with in any health service, although it does present notable differences depending on the specialty. While some branches of medicine almost completely guarantee the mandatory daily rest of the MIRothers fail to comply systematically.
The study has placed Neurosurgery as the discipline that most abuses doctors during their residency period. The survey has revealed that in the 69 percent of cases Physicians in training have not been able to enjoy the obligatory daily rest that must be taken following a shift. The regulations currently contemplate that it is necessary to stop at least 12 hours between shiftsas well as respect a period of 36 hours uninterrupted out of the health center every week.
The second most unfulfilling specialty ands Angiology and Vascular Surgery, where the rest stipulated by law is not fulfilled in el 60 percent of the guards carried out by the residents. While the podium is completed by the area of Ophthalmology. In this case, a 55 by the way of these extra shifts are not accompanied by the corresponding break.
On the other side of the scale are the good data presented by the area of Pediatrics and its Specific Areas that respects the breaks of practically all the doctors of the MIR. just the 3 percent of their subsequent payrolls are interrupted. Figures very similar to those reflected in Anesthesiology and Resuscitation (4 percent) or in Endocrinology and Nutrition (4 percent).
After analyzing all the figures, the authors of the report have concluded that this infringement of rights is linked to a large extent to the typology of each specialty. The surgical groups is the one that comes out worse off since it does not respect the breaks in 39 percent of the occasions, compared to 14 percent that reflect the non-care medical branches.
The MIR make 15 guards every quarter
The report prepared by the Collegiate Medical Organization has calculated that the number of guards carried out by MIR in the last quarter exceeds 15, something that contravenes the European Labor Directive. “The ordinary working day of the MIR in Spain is on average 37.5 hours a week. The cut-off point for non-compliance with the ceiling of 48 hours It was established at greater than or equal to five guards, which is the most restrictive interpretation possible”, its authors have pointed out.
The data has been obtained from a survey carried out on 2,035 doctors between the months of April and May, of which the 65 percent are women. The conclusions have already been presented both in the Ministry of Health as well as the different parliamentary groups of the Congress of Deputies to articulate measures that preserve the labor rights of resident doctors. The next step is to take it to Ombudsman.
